Divorce case and cup of tea

Question

A person says to his wife, “If any person drinks any tea from the mug, you are divorced thrice. If any of it is poured down the sink or elsewhere, you are divorced thrice. If any of it remains in the mug after 72 hours, you are divorced thrice.” Can anything be done to avoid the divorce occurring or will the three divorces occur?

Answer

Insert lots of tissue in the mug and clear the mug from any tea before the 72 hours expire. If this is done, divorce will not occur because no person drank the tea, nor was it poured out of the cup, nor will any tea remain therein.

It must be noted that such phrases and threats must be avoided. Divorce should not be treated lightly. The rulings pertaining to divorce are extremely delicate, and sometimes there may not be a solution. Therefore, caution must be exercised, and where necessary a person should only give one divorce.

قال الفقيه أبو الليث السمرقندي في النَّوازل المطبوع باسم الفتاوى من أقاويل المشايخ في الأحكام الشرعية (ص ٧٠٨): وسئل بعضهم عن رجل قال لامرأته وفي يدها قدح من ماء: إن شربت الماء فأنت طالق، وإن صببتيه فأنت طالق، وإن وضعتيه أو دفعتيه إلى إنسان فأنت طالق؟ قال: يرسل فيه ثوبا حتى ينشف الماء، انتهى. ونقله ابن الشحنة في لسان الحكام (ص ٤٣٦). وفي كتاب الأيمان من الفتاوى الهندية (٢/٩٦) عن فتاوى قاضي خان (١/٥٩١): رجل قال لامرأته وفي يدها قدح من ماء: إن شربت هذا الماء أو وضعته أو صببته أو أعطيته إنسانا فأنت طالق، قالوا: ترسل فيه ثوبا أو قطنا حتى ينشف الماء، وهذا إذا قال في يمينه: أو شيئا منه، وإن لم يقل أو شيئا منه فشربت البعض وصبت البعض لا يكون حانثا، انتهى۔
