Income from an Interest Business

Question

Assalaamu ‘Alaykum ww.

Respected Mufti saheb,

I would like to know the following:

(a)An employee receives salary & other emoluments from an employment, which deals in interest (riba). However, this particular employee is NOT at all involved directly in any  Interest (Riba) transactions / dealings, Neither does he sign Nor bears witness to any Interest dealings on behalf of the company he is working for.  Is such an employee’s earnings (salaries) Halaal ?      Is Zakaat paid on such accumulated salaries accepted?

(b) I have been offered to work as an accountant at an establishment , which deals in Landscaping & Lodges.  They have expanded their business activities to also include small Housing units to let out (give them out on rent).  However, they also have a Restaurant & a bar, which caters for the wider community.  I would like to know whether or not, to accept this Job Offer.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

You refer to two issues in your query:

(a) Receiving income from an interest bearing business.

(b) Working as an accountant.

 

Your desire to adopt a halaal course of action is encouraging. Adopting halaal invokes the mercy of Allah Ta’laa and barakah in one’s wealth.

(a) In principle, two aspects are considered before determining the Shari’ah compliancy of a job:

  1. The profile/description of the job.
  2. The major source of the funds from which the employee will be remunerated.

If the job entails actively engaging in any Haraam activities, then it will be Haraam to carry out such a job.[1]

However, if the job does not entail any Haraam activities, then the major source of the employer’s income should be considered.

If the employer’s major source of income is Haraam, then it is not permissible to work for such an employer. The income derived from such a job will not be Halaal. [2]

Nabi (ﷺ) said:

طَلَبُ كَسْبِ الْحَلَالِ فَرِيضَةٌ بَعْدَ الْفَرِيضَةِ

Translation: Earning of Halal income is an obligation beyond other obligations.

(Shuabul Imaan/Sunan Al-kubra, Baihaqi)

If majority of the employer’s income is from Halaal sources, but he is known to be conducting fraudulent business deals, operating his business on interest bearing loans or engaging in other Haraam activities, then it is legally correct but morally incorrect to accept the employment of such an employer. The employee may also end up tarnishing his reputation by accepting such a job.

(b) It is permissible to work as an accountant in the place in reference. The income from that service is halaal. [3]

ولو أن رجلاً أهدى إليه إنسان يكتسب من ربا أو رجل ظالم يأخذ أموال الناس أو اضافة فإن كان غالب ماله من حرام فلا ينبغي له أن يقبل ولا يأكل من طعامه ما لم

يخبره أن ذلك المال أصله حلال ورثه أو استقرضه أو نحو ذلك . فإن كان غالب ماله حلال فلا بأس بأن يقبل هديته ويأكل منه ما لم يتبين عنده أنه من حرام .

جہاں تک حرام مال سے تنخاہ ملنے کا تعلق ہے، اس کے بارے مین شریعت کا اصول ہے کہ اگرایک مال حلال وحرام سے مخلوط ہو اور حرام مال زیادہ ہو تو اس سے تنخواہ یا ہدیہ لینا جائز نہیں، لیکن اگر حرام مال کم ہو تو جائز ہے

اور سود لينا مسلمان سے تو مطلق حرام ہے، اور کفار سے لینا بعض علماء کی نزدیک حرام ہے، مگر جب وہ قلیل ہے اور زیادہ آمدنی بے سودی ہے، تو ملازم کی دکان کا تنخواہ لینا جائز ہے جبکہ تنخواہ مال مخلوط سے دی جاۓ۔ اس طرح جب اشیاء حلال زیادہ ہیں تو غلبہ حلال کو ہے

اگر حلال وحرام آمدن کو خلط کر دیا جاتا ہے اور حلال کو الگ رکھنے پر ادارہ تیار نہ ہو تو اس کا حکم یہ ہے: “حلال وحرام مخلوط ہوں لیکن حلال غالب ہو تو اس سے اجرت لینا جائز ہے اور اگر حلال وحرام دونوں برابر ہوں یا حرام غالب ہوں تو جائز نہیں
