Question

The default ruling is that a Christian child should not inherit from their Muslim father. Is this correct? Has any Ulama written otherwise?

Answer:

The general and default ruling is that Muslims do not inherit from no-Muslims and vice versa.

We have not come across any ruling from the scholars of Ahlul Sunnah wal Jamaa’ which contradicts the hadith of the Prophet (s.a.w.) that states,

”A Muslim is not entitled to inherit from a non-Muslim, and a non-Muslim is not entitled to inherit from a Muslim.”[1] This is the general ruling of the scholars of Fiqh.[2]
