Can the Imam conducting the Nikah also be one of the Witnesses?

Question

Is there any problem in the imaam who is conducting the nikah to also be the witness of the representation?

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

In order for a Nikah to be valid witnesses are required. The minimum number of witnesses is two males or one male and two females.[1]

The Imaam conducting the Nikah may also be one of the witnesses, provided that other than him there are another male or two females who are witnesses.

[1] (ومنها) الشهادة قال عامة العلماء: إنها شرط جواز النكاح هكذا في البدائع وشرط في الشاهد أربعة أمور: الحرية والعقل والبلوغ والإسلام… ويشترط العدد فلا ينعقد النكاح بشاهد واحد هكذا في البدائع ولا يشترط وصف الذكورة حتى ينعقد بحضور رجل وامرأتين، كذا في الهداية ولا ينعقد بشهادة المرأتين بغير رجل وكذا الخنثيين إذا لم يكن معهما رجل هكذا في فتاوى قاضي خان.
