Iddah Of A Woman Whos Was Given A Talaaq-e-Baain

Answered as per Hanafi Fiqh by Darulifta Azaadville

Question:

While a women is carrying out her Talaaq Bain, her husband passes away. When will her Iddah end?

Answer:

If the husband issued the Talaaq while he was healthy (i.e. not in Marudhul Maut – that illness which causes the death of a person) due to which she will not be entitled to receiving any inheritance, then her Iddah period will be three menstrual cycles, if she experiences menses; or alternatively three months if she does not experience menses. If she has conceived, the ‘Iddah will be until delivery.

If she does inherit as in the case where he issued the Talaaq while he was in Marudhul Maut (that illness which causes the death of a person), then her Iddat period will be whichever of the two ends last between three menstrual cycles and four months and ten days.
