How shall we distribute the inheritance of my grandparents?

Answered as per Hanafi Fiqh by AskOurImam.com

Respected mufti

Assalamulaikum

Please advise me as to the correct way of distributing inheritance of my late grandfather.

The amount to be distributed is R48, 779,712

Scenario. 1

Survived by:

  1. Wife – (deceased in 1988)
  2. Daughter
  3. Daughter –
  4. Mother, 1 sister & 4 brothers

Scenario. 2

  1. Wife – survived by:

1.1 sherbanu- daughter

1.2 zubeda- daughter

1.3 ebrahim – brother (deceased before ayesha)

1.4 ismail – brother (deceased before ayesha)

1.5 abdul haq – brother (deceased before ayesha)

1.6 hawaii bibi – sister

1.7 sarah – sister

1.8 khatija – sister

1.9 amina – sister

Is it possible for you to work out for us the two scenarios separately? I.e when my nana passed away. And thereafter when my nanni passed away

Jazakallah

We were advised that your grandfather was survived by his wife, mother, sister, 2 daughters and 4 brothers. Accordingly, the inheritance of your grandfather will be distributed as follows:

Beneficiaries

The deceased`s estate will be divided

Into 216 equal shares as follows:

Will receive (in R) from

total of R 48, 779, 712

Wife 27 6, 097, 464
2 Daughters 144 (72 each) 16, 259, 904 each
Mother 36 8, 129, 952
1 sister 1 225, 832
4 brothers 8 (2 each) 451, 664 each

Similarly, we were advised that your grandmother was survived by her 4 sisters and 2 daughters. Accordingly, the inheritance of your grandmother, Ayesha, will be distributed as follows (this is based on the assumption that she did not possess anything besides that which is inherited from her husband, your grandfather):

Beneficiaries

The deceased`s estate

will be divided as follows:

will receive (in R)

From total of R 6, 097, 464

4 Sisters 1/3 508, 122 each
2 Daughters 2/3 2, 032, 488 each

Please note: After combining both the scenarios, both the daughters, Sherbanu and Zubeda, each will inherit R 18, 292, 392 in total.

The predeceased brothers will not inherit anything.
