Marriage and Father’s Permission

Answered as per Hanafi Fiqh by Askmufti.co.za

Q: A son decided to get married but his parents are divorced (talaq). Can he get married without his father’s permission or without asking the father?

A: It is permissible for a boy to get married without his father’s consent or permission. Such a nikah (marriage) will be valid.

However, it is strongly recommended that he gets his fathers blessings for the nikah because the father might feel hurt if he gets married without the father’s knowledge or consent, and the son will be sinful for hurting the father. The Holy Quran prohibits hurting parents by just saying to them “uff”. Obtaining the father’s blessings and happiness will also be a means of barakah for his nikah, insha Allah.
