Is there zakaat on gold owned by my daughters?

Answered as per Hanafi Fiqh by Askimam.org

My wife has 30 Tola Gold in her possession. She distributed 15 Tola Gold each between our two daughters ( One is 9 Years Old and other is 5 Years Old ) as she does not want to keep any wordly item in her possession. Till date she use to take out Zakaat on 30 Tola Gold each year, Now my question is, since she distributed her Gold between our daughters and they are not baligh, is it obligatory to take out Zakaat each year on Gold in possession of our daughters. – Jazakallah Khair.

Answer

In the Name of Allah, the Most Gracious, The Most Merciful.

As-salaamu `alaykum wa-ramatullahi wa-barakatuh.

If your wife gifted her gold to the two daughters and has relinquished all rights of ownership over the gold, then the two daughters are the owners of the gold. There will be no zakaat due on your wife for the gold as she is no more the owner of the gold. There will be no zakaat on your daughters too as they are minors. There is no zakaat on minors. If the girl who is 9 years old, has attained puberty (baaligah) then she will be regarded as an adult in Shariah and she will have to give zakaat on her share of the gold.[1]
