Entitlement of wealth

Answered as per Hanafi Fiqh by Askimam.org

Assalamualikum dear Mufti sab,

This is regarding the family one of my relatives. They are 3 in number. Husband, wife and a daughter (married). Husband has got psychological problem and is not sane. They have lot of wealth. Wife is taking care of her husband as daughter is with in-laws. Following are the concerns.

  1. For spending on Husband’s treatment and other expenses is there any cap on amount to be spent?
  2. What will be wife’s right on the wealth?
  3. What will be daughter’s right on the wealth?

Kindly clarify the same in light of Shariah. Jazak ALLAH khair.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

We take note of the contents of your email. May Allah grant the family courage to overcome their predicament. Aameen.

1. If the wealth belongs to the husband, the wealth may be used to fulfill his needs. There is no cap of any amount on his wealth to be used for him.

2/ 3. The wife and daughter may fulfill their needs from the wealth.[1]
