Health insurance for family

Answered as per Hanafi Fiqh by Askimam.org

With utmost humbleness towards Muftiyan-e-ikram I would like to say that, I am asking this question for the third time since more than a month or so. I still have not got a reply for the same. I have added some extra information this time for better clarity. I work in an MNC in India.

As part of medical benefits my company pays 100% of Medical Insurance premium for the employee (i.e. me). Whereas for my dependants viz. my wife, children, parents (or) parents-in-laws, I will have to pay 10% (or 20% for a different plan)of the premium which is few hundreds of Rupees per person.

The remaining 90% (or 80%, if the higher plan is availed) of the premium which is few thousands of Rupees is paid by the company. No matter which plan of medical Insurance I avail, the company pays 100% of the insurance amount for me. From Fatwa#: 9817 and many other fatwas of askimam.org I understand that I can avail the benefit as a gift. However, I would like to kindly know whether could I avail the benefits for my wife(she is the only dependant now). If yes, can I also avail it for my in-laws since I would have to pay only few hundreds (i.e. just 10% of the whole amount).

My parents already have medical aid benefits, since my father is a government servant in India. Kindly note, unlike the conventional insurance schemes which covers only those ailments which uncertainly come up after availing the insurance.

The medical insurance benefit my company gives is valid even for all the ailments which are present before availing the insurance. It also covers reimbursement for pregnancy. I have read in Fatwa#: 18041 that if the insurance premium amount is deducted from our salary without our consent, then we may avail the medical benefits. However, in my case, though the amount deducted from my salary is bare minimum for my dependants medical insurance.

Its still under my discretion to enroll my dependants for the medical insurance benefits. No money is deducted from my salary without my consent.

In the Name of Allah, the Most Gracious, the Most Merciful.

According to the explanation given in your query, it is not permissible for you to take out medical insurance coverage for your family members.
