Inheritance Case Scenario

Answered as per Hanafi Fiqh by DarulIftaBirmingham

Answered by: Maulana Mohammed Haroon Hussain

Question:

If a woman passes away leaving behind only a mother, 2 sisters, 1 brother and nieces and nephews, who inherits?

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

In the above case, the estate will be split into 24 equal parts. The table below shows how much each person will get from this total of 24.

Mother Brother Sister 1 Sister 2 Nieces/Nephews
10

The nephews and nieces will not inherit due to the presence of the brother and sisters of the deceased.[1]

The above calculation is for the case provided only. It is assumed that there is neither a husband of the deceased nor any children still alive. If the husband is alive or there are children, then the calculation will need to be done again, so please contact us again in that event.

Only Allah knows best
