Salaams i was hoping you could help
I recently returned from a holiday to turkey. There we visited a masjid on friday. There was a seperate area for women and the women there also prayed in congregation behind the imam. I was abit confused what to do as i normally pray at home and only time I’ve ever prayed behind an imam is in the haram. Whats the ruling for women to pray in congregation

Answer

Wa’alaykum as Salam wa rahmatullahi wa barakatuhu,

it is Makrooh Tahrimi (highly detestable/close to Haram) for women to go out specially to attend the congregational prayers. This is irrespective weather one is in their home town, travelling, or even at the Harams. After stating the prohibition of women attending congregational prayers, Mufti Abdur Raheem Lajpuri (may Allah be pleased with him) said: “This law is general. Be it the Haram Shareef or Masjid un Nabawi, be it India or the Arab countries, this law is general.” (See Fatawaa Rahimiyah vol.1 pg.173)

The following is regarding a female who not only wanted to pray in the Haram, but she could have prayed directly behind the greatest Imam ever, the Prophet (sallallahu alayhi wa sallam):

قال ابن خزيمة أخبرنا أبو طاهر نا أبو بكر نا عيسى بن إبراهيم الغافقي ثنا ابن وهب عن داود بن قيس عن عبد الله بن سويد الأنصاري عن عمته امرأة أبي حميد الساعدي : أنها جاءت النبي صلى الله عليه و سلم فقالت : يا رسول الله صلى الله عليه و سلم إني أحب الصلاة معك فقال : قد علمت أنك تحبين الصلاة معي و صلاتك في بيتك خير من صلاتك في حجرتك و صلاتك في حجرتك خير من صلاتك في دارك و صلاتك في دارك خير من صلاتك في مسجد قومك و صلاتك في مسجد قومك خير من صلاتك في مسجدي فأمرت فبني لها مسجد في أقصى شيء من بيتها و أظلمه فكانت تصلي فيه حتى لقيت الله عز و جل (أخرجه ابن خزيمة في صحيحه – 3/ 95)

“Umm Humayd (may Allah be pleased with her), the wife of Abu Humayd al-Saa’idi, (may Allah be pleased with him) came to the Prophet (sallallahu alayhi wasallam) and said, “O Messenger of Allaah, I would love  to pray with you.” The Prophet (salallahu alayhi wa wasallam) said, “I am well aware that you like to pray with me, but your prayer in your room is better for you than your prayer in your courtyard and your prayer in your courtyard is better for you than your praying (anywhere else) in your house, and your prayer in your house is better for you than your prayer in your local Masjid, and your prayer in your local Masjid is better for you than your prayer in my Masjid.” (Hearing this), Umm Humayd commanded that a prayer-place be prepared for her in the furthest and darkest part of her house, and she used to pray there until she met Allaah (i.e., died).” (Saheeh Ibn Khuzaymah – 3/95)

Similarly, our mother, ‘Aaisha (may Allah be pleased with her) uttered the following statement whilst in the holy lands,

عن عمرة بنت عبد الرحمن أنها سمعت عائشة زوج النبي صلى الله عليه وسلم تقول * لو أن رسول الله صلى الله عليه وسلم رأى ما أحدث النساء لمنعهن المسجد كما منعت نساء بني إسرائيل قال فقلت لعمرة أنساء بني إسرائيل منعهن المسجد قالت نعم (أخرجه مسلم في صحيحه – 1/ 329)

“If the Messenger of Allah (sallallahu alayhi wa sallam) had seen what new things that women have introduced (in their way of life) he would have definitely prevented them from going to the mosque, as the women of Bani Isra’il were prevented.” (Sahih Muslim, 1/329)

Who could be better in understanding the emotions and feelings of the Prophet (sallallahu alaihi wasallam) than his noble wife,  ‘Aaisha Siddiqah (may Allah be pleased with her)? She uttered these statements in response to someone who complained that the second Khalifa, ‘Umar (may Alah be pleased with him) is prohibiting females from attending the prayer in congregation. In her capacity of being the wife of the Prophet (sallallahu alaihi wasallam) and also the champion of women’s rights, she could also have objected by saying that how can ‘Umar (may Allah be pleased with him) snatch away a right given to us by Allah Ta’aala and His beloved Messenger (sallallahu alaihi wasallam)? However, she endorsed the prohibition. 

After studying all the narrations on the subject, our illustrious Fuqaha too, were forthright in prohibiting the participation of women in the congregational prayers of the Masaajid. More details can be found on the referance below, and on the following link,

Even whilst in Makkah and Madina, a female should still pray in her hotel room, and she should not go specially just to pray with the congregation. Yes, if she happens to be in the Haram (example she was making Tawaaf) at the time of Salah, then she may pray behind the Imam.

Many Masjids have areas for females to pray. If a female is travelling, and there is no other place to pray, then in those instances she may pray in the females section of the Masjid. If she happens to be at the Masjid at the time of Jama’ah, then only in that case she may pray behind the Imam.

ويكره للنساء حضور الجماعة (مختصر القدوري – ص: 29)

(ويكره للنساء) الشواب (حضور الجماعة) مطلقاً؛ لما فيه من خوف الفتنة (اللباب في شرح الكتاب – 1/ 81)

وكره لهن حضور الجماعة إلا للعجوز في الفجر والمغرب والعشاء والفتوى اليوم على الكراهة في كل الصلوات لظهور الفساد كذا في الكافي وهو المختار كذا في التبيين (الفتاوى الهندية – 1/ 89)

قوله ( على المذهب المفتى به ) أي مذهب المتأخرين
قال في البحر وقد يقال هذه الفتوى التي اعتمدها المتأخرون مخالفة لمذهب الإمام وصاحبيه فإنهم نقلوا أن الشابة تمنع مطلقا اتفاقا
وأما العجوز فلها حضور الجماعة عند الإمام إلا في الظهر والعصر والجمعة أي وعندهما مطلقا فالإفتاء بمنع العجائز في الكل مخالف للكل فالاعتماد على مذهب الإمام ا هـ
قال في النهر وفيه نظر بل هو مأخوذ من قول الإمام وذلك أنه إنما منعها لقيام الحامل وهو فرط الشهوة بناء على أن الفسقة لا ينتشرون في المغرب لأنهم بالطعام مشغولون وفي الفجر والعشاء نائمون فإذا فرض انتشارهم في هذه الأوقات لغلبة فسقهم كما في زماننا بل تحريهم إياها كان المنع فيها أظهر من الظهر ا هـ
قلت ولا يخفى ما فيه من التورية اللطيفة وقال الشيخ إسماعيل وهو كلام حسن إلى الغاية
قوله ( واستثنى الكمال الخ ) أي مما أفتى به المتأخرون لعدم العلة السابقة فيبقى الحكم فيه على قول الإمام فافهم (رد المحتار – 1/ 566)

ويكره للناس الشواب : حضور الجماعة مطلقا (تحفة الملوك – ص: 15)

(وكحضور الشابة) أي وكما كره حضور الشابة (كل جماعة) لخوف الفتنة (والعجوز) أي وكحضور العجوز (الظهر والعصر) بخلاف الفجر والمغرب والعشاء والعيدين، فإنه لا بأس عند أبي حنيفة بحضور العجوز لها. وعندهما: لا بأس بحضور العجوز للصلوات كلها لعدم الرغبة فيها. ولأبي حنيفة أن قوة الشهوة توقع في الفتنة، غير أن الفساق في الفجر والعشاء نائمون، وفي المغرب بالطعام مشغولون، وفي العيدين لسعة الجبانة عن النساء معتزلون، وكان هذا في زمانه رضي الله عنه، وأما في زماننا فكثر انتشار الفساق وقت المغرب والعشاء. والمختار: منع العجوز عن حضور الجماعة في جميع الأوقات فضلا عن الشابة. لما روى البخاري عن يحيى بن سعيد، عن عمرة ، عن عائشة رضي الله عنها أنها قالت: «لو أدرك رسول الله صلى الله عليه وسلم ما أحدث النساء، لمنعهن كما منعت نساء بني إسرائيل. قلت لعمرة: أومنعن؟ قالت: نعم». وتقول عائشة ترفعه: «أيها الناس، انهوا نساءكم عن لبس الزينة والتبختر في المساجد، فإن بني إسرائيل لم يلعنوا حتى لبس نساؤهم الزينة، وتبخترن في المساجد». رواه ابن عبد البر في «التمهيد».
