Husband calling the wife a kaafir

Answered as per Hanafi Fiqh by Muftionline.co.za

Q: I am a Muslim married women. Me and my husband are both sayeds. 15 years passed since our marriage. 2 days ago in a quarrel he called me kaafir and murtad in anger. I have doubt by using thies words my Nikah remains or not? What we have to do now?

Bismillaah

A: It is haraam to call a believer a kaafir. The one who calls a believer a kaafir has committed a major sin. Hence your husband should sincerely repent to Allah Ta’ala for calling you a kaafir and murtad and make a firm resolve that he will not repeat this sin in the future. However due to your husband committing this grave sin, your nikaah with him did not break. Your nikaah is intact.

And Allah Ta’ala (الله تعالى) knows best.
