Is surplus from the reimbursement of a doctor’s medical bill permissible to take?

I have a medical facility in my company where I can claim for reimbursement after a treatment. Now, I need to undergo a dental treatment, the cost of which would be approximately 8000. Doctor would provide me a bill of 12000, but I need to pay only 8000 to the doctor. If I submit the bill, I will get 12000 from the company. I feel that getting extra money (4000) will not be halal for me. I’d like to seek your fatwa in this regard. Is there any leeway to make the income halal?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If the doctor’s treatment is 8,000, he should only bill you that amount. It is incorrect for the doctor to bill you 12,000. It will also be incorrect for you to submit a bill of 12,000 and keep 4,000 for yourself. The inflated bill will be a lie and a deception which is Haraam[i].

Rasulullah (sallallahu alayhi wasallam) passed by a person selling a mound of food. Rasulullah (sallallahu alayhi wasallam) put his hand in the mound of food and felt that some of the food was wet. He asked the seller:

«مَا هَذَا يَا صَاحِبَ الطَّعَامِ؟» قَالَ أَصَابَتْهُ السَّمَاءُ يَا رَسُولَ اللهِ، قَالَ: «أَفَلَا جَعَلْتَهُ فَوْقَ الطَّعَامِ كَيْ يَرَاهُ النَّاسُ، مَنْ غَشَّ فَلَيْسَ مِنِّي»[ii]

“What is this, oh food seller?” The seller replied, “Rain has afflicted on it.” Rasulullah (sallallahu alayhi wasallam) said, “Why didn’t you place it (the wet part) on top so people can see it? Whoever deceives is not from me.” (Muslim: 102)

Rasulullah (sallallahu alayhi wasallam) has counted lying amongst the characteristics of a Munaafiq, a hypocrite. He said:

آيَةُ المُنَافِقِ ثَلاَثٌ: إِذَا حَدَّثَ كَذَبَ، وَإِذَا وَعَدَ أَخْلَفَ، وَإِذَا اؤْتُمِنَ خَانَ[iii]

“There are three signs of a Munaafiq: when he speaks, he lies, when he makes a promise, he breaks that promise, when he is given a trust, he breaches the trust.”

One should avoid speaking lies and deception.
