May I Inherit from my Non-Muslim Father?

 My father is a non-Muslim and I informed him that I cannot inherit from him unless he writes a will for me, and he refuses to write a will because he says that the law in Western lands already gives me a right to his inheritance. Is it permissible for me to inherit from him based on the law of the country in which he lives?

He wrote me a letter saying that he permits me to inherit his wealth. Does this letter constitute a will that would permit me to inherit from him?

Inheritance in the Presence of other Heirs

[h: The Sacred Law gives non-Muslims the inalienable right to exclude their Muslim relatives from inheriting the wealth of a common non-Muslim relative. It is not permissible for a Muslim to deprive his non-Muslim relatives of this right and it is consequently] not permissible for a Muslim to inherit from a non-Muslim, even if the non-Muslim is a parent, because the Prophet (Allah bless him and give him peace) said, “A Muslim may not inherit from a non-Muslim.” The fact that the law of the land gives Muslims the right to inherit from their non-Muslim relatives does not affect this ruling. For you to appropriate the wealth left behind your non-Muslim father in the presence of other rightful heirs, such as your father’s brothers, paternal uncles, etc. would constitute depriving them of what is rightfully theirs.

Inheritance through Bequest

It is, however, permissible for you to take ownership of up to one-third of your deceased father’s estate if he gives it to you by way of a bequest while he is still alive. The letter that you mention in your question would count as a valid bequest if (a) it is worded as a bequest is worded and (b) if your father intended while writing the letter that he was making you a bequest. Otherwise, it does not count as a bequest. If the exact intention of the deceased is unknown and he is no longer alive to clarify what he intended, then the bequest is invalid. (cf. the Tuhfa and Mughni)

Note that if there are other heirs present, it is not permissible for you to inherit more than one-third of the estate by bequest, unless the other heirs forego their right and allow you to take their share.

Inheritance in the Absence of other Heirs

It seems, however, to this impoverished soul that if (a) you know that your father has no other heirs [h: that are recognized by Sacred Law] besides yourself, and if (b) the law of the land rules that you are entitled to your father’s inheritance, it is permissible for you to take ownership of the estate. This is based on the words of Ibn Hajar in the Tuhfa (7.130), and was approved by my teacher, the scholar of exacting verification, Shaykh Muhammad b. `Ali al-Khatib.

 

السؤال: أسلمت وأبي لم يسلم وقلتُ له إنه لا يجوزُ لي أن أرثَ منه إلا إن كتبَ لي وصيةً فأبى؛ بناءً على أن القانون في الغرب يجعلني مستحقاً لتركته؛ فهل يجوز لي أن أرثه بناءً على القانون؟ ثم كَتَبَ لي رسالةً قال فيها: إنه يسمح لي أن أرث ماله. فهل يعتبر ذلك وصية شرعاً فيجوز لي أن أرثه؟

الجواب: لا يجوز للمسلم أن يرثَ غيرَ المسلم ولو كان أحدَ أبويه؛ لقوله صلى الله عليه وسلم:” لا يرثُ المسلمُ الكافرَ “. وجَعْلُ القانون لك مستحقاً لا عبرةَ به فلا يجوز لك الميراثُ من أبيك غير المسلم؛ لأن الشرعَ حَجَبَك عن الاستحقاق بالميراث فصار الحقُّ في مال أبيك لغيرك من بقية ورثته ولو عصباته كإخوته وأعمامه وأبناء عمومته.

أما ما كتبه لك أبوك في الرسالة؛ فإن كان بصيغةٍ تُشْعِرُ بالوصية ونوى الوصيةَ حال الكتابة واعترف بنيته ذلك نطقاً هو أو ورثتُهُ صحتْ وصيتُهُ، وإلا فلا. هذا هو المقررُ في مذهبنا بخصوص مسألتك كما في “التحفة” و”المغني” وغيرهما، والله أعلم. قال في “التحفة”:” فإن جهل ما أراد به بطل “. اهـ وقال:” (والكتابة) بالتاء (كناية) فتنعقد بها مع النية ولو من ناطق، ولا بدَّ من الاعتراف بها نطقاً منه، أو من وارثه وإن قال هذا خطي وما فيه وصيتي، وليس للشاهد التحمل حتى يقرأ عليه الكتابَ أو يقول: أنا عالمٌ بما فيه “. اهـ وإذا قلنا بصحة الوصية فإنما تستحقُّ بها ثلثَ تركتِهِ لا كلها إلا إن أجاز ورثتُه.

نعم إذا علمتَ أنه ليس لأبيك وارثٌ غيرك لا من أصحاب الفُرُوض ولا غيرهم من الورثة، ثم إن القانونَ قد حَكَمَ لك بملك هذا المال؛ فالذي يظهرُ للفقير جوازُ أخذك لهذا المال؛ أخذاً مما قرَّره العلامةُ ابنُ حجر في “التحفة” في باب قسم الفيء (7/130): من أن المسلمَ يملكُ ما يأخذُهُ من غير المسلمين إذا كان ذلك بعقدٍ كالبيع والهبة أو نحوه مما لا منةَ فيه للمأخوذ منه. وأقول: إن حكمَ القانون لك بملك مال أبيك الذي علمتَ أنه لا وارثَ له غيرك لا منةَ لأحدٍ عليك فيه، فيدخلُ فيما قرَّره الشيخ ابن حجر من أنه يكون مملوكاً للآخذ. أما إن كان لأبيك وارثٌ غيرك فالتركةُ له ولا تستحق أنت منها شيئاً، إلا أن يتبرع لك الورثة بها أو بشيء منها، والله أعلم بالصواب. وقد عرضتُ هذا الجواب على شيخنا الفقيه المحقق   محمد بن علي الخطيب فاستحسنه، والحمد لله رب العالمين.
