Upon whom does Haj become Fardh?

For Haj to become Fardh, the following conditions should be found in an individual:

  1. To be a Muslim; Haj is not fardh upon non Muslims. It will not be counted, even if they were to perform it.
  2. To be mentally fit (sane, Aaqil). Haj is not fardh upon an insane person. (A majnoon)
  3. To be physically mature, (baaligh). Haj is not fardh upon minors. (Non baaligh).
  4. To be physically capable of travelling to Makkah Mukarramah and performing Haj. Or at least having some support to be able to do so. Haj will not be fardh upon severely disabled, handicapped persons.
  5. 5. To have sufficient expenses for travelling, food, medication, accommodation and any other necessary requirements.
    This can vary. Residents in Makkah can walk it to Mina, Arafat & Muzdalifa. Those living close by can drive there. Those abroad have to take flights. Haj will become Fardh with minimum costs. One should not wait to have enough wealth for going in a 5 star luxury group. One should travel as soon as possible, with the most reasonable group available.
  6. To have sufficient wealth to leave expenses for those who depend on the person, ie. wife & children. (If they are left behind)
  7. The route being secure; If there is danger along the way, eg. a war has broken out (Allah forbid) and life could be at risk, then one can postpone the Haj until calmness prevails.
  8. A woman must not be in Iddah (ie waiting period after; divorce, which is 3 mensturations, or after; death of the husband, which is 4 months and 10 days.)
  9. A woman must have the company of her husband or of a Mahram (an adult male whom she is not permitted to marry due to being closely related eg father, son, brother, grandson, uncle.)

If she cannot find a Mahram, she should leave the wealth on one side and make an intention that as soon as she finds one ready to travel with her, she will travel. If death approaches, she should leave a will for Hajje Badal to be performed on her behalf. The will should be carried out from one third of the legacy.
