Permissibility of Funds

Assalam-u-alaykum

Please can mufti-saheb assist with the following scenario.

Person A (willingly) borrows Person B a bank card to sign up and pay for a subscription to an online movies and series streaming service.
The agreement between Person A and Person B, is that Person B will use Person A’s card and thereafter, return the equivalent amount used, in cash to Person A.

1) is it permissible for Person A to accept this cash amount from Person B?
2) Furthermore, each time an amount is deducted from Person A’s card for this service, is it permissible for Person A to request Person B to reimburse Person A for the amount which has been deducted?
3) in the instance where Person B does not remember to cancel the subscription to the service, is it permissible for Person A to email the company concerned and request the company themselves to cancel the service and reimburse Person A for the money which has been deducted from Person A’s account?

Answer

Wa’alaykum as Salam wa rahmatullahi wa barakatuhu,

1, 2) Due to the impermissibility of movies and films, it will not be permissible for Person A to take any funds from person B.

3) Yes, this is permissible. It will be permissible to take back the funds for future months. As for previous months, if they reimburse payments inspite of Person B enjoying their service, then such funds should be given in charity without the hope of reward.

In addition to the above, person A needs to repent for facilitating and assisting person B in the disobedience of Allah.
