Benefiting from Sadaqah funds

Question

السلام عليكم ورحمة الله وبركاته

I hope our Muftiyaan are well.

If I have sadqah or lillah money and I use them on something which I myself benefit from, is it permissible for me to take benefit from the sadqah or lillah money i spend?

E.g buying ZESCO units or buying a carpet for the masjid.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Sadaqah refers to charity discharged to the poor and needy for the pleasure of Almighty Allah. [1]

In principle, the discharge of Sadaqah will be complete once the funds or the item has been disposed to the needy person. Until the needy person has not taken possession, the Sadaqah funds will still belong to the owner.  [2]

Accordingly, if a person is in financial constraint or in need of the funds, he may utilise the funds set aside for Sadaqah, as spending on one’s family is also considered Sadaqah. [3]

This is further understood from the following Hadeeth:

عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ “‏ نَفَقَةُ الرَّجُلِ عَلَى أَهْلِهِ صَدَقَةٌ

Translation: Nabi () said, “A man’s spending on his family is a deed of charity.”

(Saheeh Al-Bukhari)

However, the purpose of keeping aside Sadaqah funds is to also nurture the children to spend in the path of Allah.

If that donated money will be used for personal needs and that is observed by the children, then the purpose of keeping aside the Sadaqah funds will be defeated and in fact it may have an adverse effect. The children may tend to think that money donated for the path of Allah may be used for oneself.

Whilst it is permissible to utilise the funds kept aside for Sadaqah for one’s own benefit, if one is not in financial constraint, it is advisable to dispose the Sadaqah funds to the poor and needy.

 وَالصَّدَقَةُ كَالْهِبَةِ – عِنْدَنَا – فِي أَنَّهُ لَا يُوجَبُ الْمِلْكُ لِلْمُتَصَدَّقِ عَلَيْهِ إلَّا بِالْقَبْضِ خِلَافًا لِمَالِكٍ – رَحِمَهُ اللَّهُ –

وَفِي الصَّدَقَةِ خِلَافٌ بَيْن الصَّحَابَةِ، وَمَنْ بَعْدَهُمْ – رَضِيَ اللَّهُ تَعَالَى عَنْهُمْ -، وَكَانَ عَلِيٌّ وَابْنُ مَسْعُودٍ – رَضِيَ اللَّهُ عَنْهُمَا – يَقُولَانِ: إذَا أَعْلَمْت الصَّدَقَةَ جَازَتْ، وَكَانَ ابْنُ عَبَّاسٍ وَمُعَاذٌ – رَضِيَ اللَّهُ عَنْهُمْ – يَقُولَانِ لَا تَجُوزُ الصَّدَقَةُ إلَّا مَقْبُوضَةً. وَعَنْ شُرَيْحٍ وَإِبْرَاهِيمَ النَّخَعِيِّ – رَحِمَهُمَا اللَّهُ تَعَالَى – فِيهِ رِوَايَتَانِ ذَكَرَهُمَا فِي الْكِتَابِ؛ فَأَخَذْنَا بِحَدِيثِ ابْنِ عَبَّاسٍ – رَضِيَ اللَّهُ عَنْهُمَا -، وَحَمَلْنَا قَوْلَ عَلِيٍّ، وَعَبْدِ اللَّهِ بْنِ مَسْعُودٍ – رَضِيَ اللَّهُ عَنْهُمَا – عَلَى صَدَقَةِ الرَّجُلِ عَلَى وَلَدِهِ الصَّغِيرِ، وَذَلِكَ بِالْإِعْلَامِ يَتِمُّ؛ لِأَنَّهُ يَصِيرُ قَابِضًا لَهُ

شرح مختصر الطحاوي للجصاص (2/ 398)

 وصدقة التطوع تجزئ على الأب والأم والذمي والغني من غير ضرورة، كما تجزئ صلاة الراكب إلى غير القبلة تطوعًا من غير ضرورة

 

بدائع الصنائع في ترتيب الشرائع (4/ 42)

وَأَمَّا صَدَقَةُ التَّطَوُّعِ فَيَجُوزُ دَفْعُهَا إلَى هَؤُلَاءِ وَالدَّفْعُ إلَيْهِمْ أَوْلَى ؛ لِأَنَّ فِيهِ أَجْرَيْنِ أَجْرُ الصَّدَقَةِ وَأَجْرُ الصِّلَةِ وَكَوْنُهُ دَفْعًا إلَى نَفْسِهِ مِنْ وَجْهٍ لَا يَمْنَعُ صَدَقَةَ التَّطَوُّعِ

قَالَ النَّبِيُّ : صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ { نَفَقَةُ الرَّجُلِ عَلَى نَفْسِهِ صَدَقَةٌ وَعَلَى عِيَالِهِ صَدَقَةٌ وَكُلُّ مَعْرُوفٍ صَدَقَةٌ }
