What is an Islamic Judge?

In the name of Allah, the most Beneficent, the most Merciful.

Answer

An Islamic judge is called a Qadhi in Arabic who rules in accordance with the Shariah. The Qadhi ensures the establishment of justice on the basis of the laws of the Shariah.

In order to appoint any person as a Qadhi the following qualities must be found in that person:

  1. Islam
  2. To be sane
  3. Maturity
  4. Must be able to stand witness in Muslim cases.
  5. He must have sound knowledge of Islamic law with its sources according to the commentary laid down by the companions of the Prophet of Allah Sallallahu Alahi Wasalam, Tabieen and Tabi tabieen. (Hidayah p.131 v.3)
