Inheritance Case

Answered as per Hanafi Fiqh by DarulIftaBirmingham

Inheritance Case

In the name of Allah, the most Beneficent, the most Merciful.

Answer

The total asset of the deceased will be distributed in the following ways:

8/16_______________________________________________Madhrub2:

WIFE                                        DAUGHTER                           6 SISTER

1|2                                                   4/8                                           3/6

The deceased property will be distributed into 16 shares. The wife will receive two shares; the daughter will receive eight shares whereas the six sisters will receive a total of six shares with each receiving one share.

The aforementioned scenario is a situation where the right of the daughters and sisters are combined. Saaiduna Zaid Ibn Thabit adiallahu Anhu ruled that when there are surviving sisters and daughters, the sisters should be treated as an asabah (heirs with no fixed shares) and should receive only the remainder.
