What is the period of forbidding milk according to Hanafi jurisprudence?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
What is the period of forbidding milk according to hanafis and many ahlay hadiths quote tafsir e usmani and say hanafis have 2.5 yrs and quran says its 2 yrs. its really confusing, plz help me.

Answer

(Fatwa: 968/908=D/1429)

According to the preferred fatwa of the Hanafi Fiqh, it is two years. According to Imam Abu Hanifa (RA), it is two and a half year as per the verse of the Quran: وحمله و فصاله ثلثون شهراً   in which two things are mentioned (i.e. pregnancy and weaning period). So, thirty months is the period of each. The evidence of Imam Abu Yusuf and Imam Muhammad (RA) is  حولین کاملین(two whole years) as the verse 2:233. In Hanafi Fiqh, the fatwa is given according to the opinion of Imam Abu Yusuf and Imam Muhammad:

قال في الدر المختار: هو حولان ونصف عنده و حولان فقط عندهما وهو الاصح فتح، وبه يفتی كما في تصحيح القدوري (شامي: 2/441). قال في البحر والاصح ان العبرة لقوة الدليل ولا يخفي قوة دليلهما (3/389)

Some scholars have preferred the saying of Imam Abu Hanifa RA; hence, out of precaution, it is better to act on his view.
