Can a Muslim woman fight for her rights under the Indian Penal Code?

My cousin sister has been married for the last 26 years and has three children ( 2 Mature unmarried daughters and a minor son). Her husband has been treting her very badly, abusing her mentally, not giving her any money for running the house and for the childrens education. She is fed up with her marriage and has threatened suiside. She wants to leave her husband, but she cant as she has no one to provide her financial assistance for raising the children. What can she do and what are her rights according to the muslim law. can she fight under the Indian Penal code , being a muslim ?

You should create the fear of Allah in your heart and must not utter any wrong words (i.e. threatening for suicide), lest Allah, who is needy of none, appoints Satan on her and she commits this major sin. She should have patient and adopt the way of taqwah.
وَمَن يَتَّقِ اللَّهَ يَجْعَل لَّهُ مَخْرَجاً [الطلاق : 2] وَيَرْزُقْهُ مِنْ حَيْثُ لَا يَحْتَسِبُ [الطلاق : 3]
Whoever fears Allah, He brings forth a way out for him, and provides him (with what he needs) from where he even does not imagine.
She should not think about separation from her husband, she should take care of her children and her own life. She should talk to her husband for reconciliation by putting two or three wise people in between so that they can pass their life in happily. What case do you want to fight in Indian Penal Court?
