What is the opinion of the learned Ulema on the following matters:
Zaid married a convert woman who told him that she was divorced. She did not tell him that she had been married (after converting) 4 times already. Before the marriage Zaid had asked her if she had any medical issues. She replied no, but he found out later that she had issues of infertility and other serious hormonal issues. Then she also had mental problems and a history of prolonged drug use until coming to Zaid. When Zaid became aware of all these issues, he decided to continue the marriage with the intent of giving her a fresh start and the right Islamic environment so she could turn around.
After the marriage Zaid bought her the Baheshti Zewar (B Z). One day she told him that their Nikah was invalid according to B Z as she had not completed her iddat from the last divorce. She said that she had been separated for four months from her ex-husband, prior to marrying Zaid and it had been only one month that the ex-husband had pronounced the word Divorce. She said that she did not know about the Iddat requirements and had thought as it already had been 4 months of separation and then the word Divorce was also uttered, so she was free to marry again. That is to say, she misunderstood the Iddat process. Zaid separated from the woman and even said the word Talaq 3 times to her.
The questions are:
1- Can she claim any “Iddat” expenses from Zaid after this “Divorce”, which she claims she can according to her study of Baheshti Zewar.
2- If she is pregnant, does Zaid need to pay her expenses during the pregnancy and for nursing the child ?
3- If the child is born, will he be a legitimate child ?
4- If he is legitimate, can Zaid demand that she hand over the newborn to Zaid , i.e., she will not have any contact with the child.
5-If he is an illegitimate child, can Zaid still make the same demand.
6- Can Zaid claim back the Mahar that he gave her ?
7- Can Zaid claim the money which he gave her (as a husband supporting his wife) to pay off her previous debts ?

1) No, she cannot claim expenses during her iddat.

2) If she is pregnant, then her iddat will be till she gives birth. Therefore, as is mentioned above, Zaid will not have to pay her expenses during this period. He will, however, have to pay for all the expenses that will be borne in order to bring up the child.

3) Yes, the child will be a legitimate child of Zaid if he/she is born at least six months after sexual intercourse took place.

4) No, he cannot demand such a thing until the child is seven years of age in the case of a boy, and nine years of age in the case of a girl. Before the child reaches this age, the mother has the right of custody. However, if there is real fear of the mother neglecting her child, then she will forfeit the right of custody. Similarly, she will forfeit the right of custody if she marries someone who is not a mahram relative of the child. After the mother, the child’s maternal grandmother is most eligible for custody over the child, followed by the maternal great grandmother then the paternal grandmother then the paternal great grandmother then blood sisters of the child then the stepsisters from the same mother then the stepsisters from the same father then the maternal aunts then the paternal aunts. If, from among the relatives of the child, no woman can be found in order to take custody of the child, the father will be the most eligible for custody.

6)In a nikaah faasid, such as the one that took place between Zaid and the woman, the man has to pay the woman whichever amount is less from the mahr al-mithl and the stipulated mahr. This is if sexual intercourse took place. Therefore, if Zaid paid this amount, he cannot claim it back. If, however, he gave more than this amount, then he may claim back the extra amount.

7) No, he cannot claim the money which he gave her to pay off her previous debts. Such a payment will come under gift. Nor can he claim the amount he spent on her as nafaqa (expenses compulsory upon the husband to support his wife).
