I am confused about the concept of implied divorce

I am confused about the concept of implied divorce. I want to understand the difference between intention and waswasah for divorce. How can I differentiate between two?

 I get divorce related random thoughts even when talking with wife about anything else. I love my wife and want to remain withn her forever. Please suggest me something that can help me.

Also please explain me how a waswah is different from a dua in heart. Please

As-salaamu ‘alaykum wa-rahmatullaahi wa-barakaatuh

May Allah Ta’ala assist you in overcoming this challenge you are dealing with. Aameen.

You stated that you are confused regarding Waswasah and divorce, you also enquired how will you know if the divorce was by your own intention or through Waswasah (whispers of Shaitaan).

Brother in Islam,

The whispers you are referring to are involuntary. Know that such thoughts are from Shaytaan. This is Shaytaan’s scheme against mankind. You are not the first to be afflicted by Waswasa. Shaytaan strives to busy ourselves with insignificant, unimportant, and irrelevant matters thereby frustrating ourselves, thus leading to anger, hopelessness, and depression.

Allah clearly states the plots of Shaytaan:

قَالَ فَبِمَاۤ اَغۡوَيۡتَنِىۡ لَاَقۡعُدَنَّ لَهُمۡ صِرَاطَكَ الۡمُسۡتَقِيۡمَۙ ُثمَّ لَاَتِيَنَّهُمۡ مِّنۡۢ بَيۡنِ اَيۡدِيۡهِمۡ وَمِنۡ خَلۡفِهِمۡ وَعَنۡ اَيۡمَانِهِمۡ وَعَنۡ شَمَآئِلِهِمۡؕ وَلَاٰ تَجِدُ اَكۡثَرَهُمۡ شٰكِرِيۡنَ سورة الأعراف:17))

Translation: Shaytaan said: ‘Since You have led me astray, I shall surely sit in ambush for them on Your Straight Path. Then I will come upon them from the front and from the rear, and from their right and from their left. And You will not find most of them thankful. )Al-Araf: 17)

One understands from this verse that Shaytaan will definitely make use of the time that was granted to him by which, he will strive to mislead man, looking for opportunities from every angle and dimension. Therefore, the simple remedy is to ignore such thoughts and engage yourself in the Zikr of Allah, and recite:

أَعُوذُ بِاللَّهِ مِنَ الشَّيْطَانِ الرَّجِيمِ

Translation: I seek refuge with Allah from the accursed Shaytaan.

Also, remember having such thoughts is a clear sign of your Imaan as it also took place during the era of our beloved Rasulullah (Sallallahu Alaihi Wasallam):

عَنْ عَبْدِ اللهِ، قَالَ: سُئِلَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَنِ الْوَسْوَسَةِ، قَالَ: تِلْكَ مَحْضُ الْإِيمَانِ (صحيح مسلم: 133)

Translation: Rasulullah (Sallallahu Alaihi Wasallam) was once asked regarding Waswasah (whispers from Shaytaan). He replied saying, that is a true sign of Imaan. (Sahih Muslim: 133)

 

You also mentioned what is the difference between Dua at heart and whispers from Shaytaan.

Whispers from Shaytaan are involuntary thoughts that are constantly bothering a person whereby when making Dua, a person acknowledges his weakness and therefore completely surrenders all of his matters to Allah Ta’ala.

Making Dua is an integral part of our Imaan as Allah makes mention of it in the Quran:

وَإِذَا سَأَلَكَ عِبَادِي عَنِّي فَإِنِّي قَرِيبٌ أُجِيبُ دَعْوَةَ الدَّاعِ إِذَا دَعَانِ فَلْيَسْتَجِيبُوا لِي وَلْيُؤْمِنُوا بِي لَعَلَّهُمْ يَرْشُدُونَ (سُوۡرَةُ البَقَرَة: 186)

Translation: And when my bondsmen ask you, (Rasulullah (Sallallahu Alaihi Wasallam)), concerning me – indeed I am near. I respond to the prayer of the supplicant when he calls upon me. So let them respond to me (by obedience) and believe in me that they may be (rightly) guided. (Al-Baqarah: 186)

Accordingly, if a person used clear words of divorce irrespective of one’s intention, then this will constitute a divorce. However, if a person uses ambiguous statements that may imply divorce, without the express intention of divorce, then that alone does not constitute divorce. The Nikah will remain intact. In this situation, the doubt of divorce is Waswasa from the Shaytaan.[i]

الطلاق على ضربين: صريح وكناية. فالصريح قوله: أنت طالق، ومطلقة، وطلقتك، فهذا يقع به الطلاق الرجعي، لأن هذه الألفاظ تستعمل في الطلاق ولا تستعمل في غيره، فكان صريحا، وأنه يعقب الرجعة بالنص، ولا يفتقر إلى النية، لأنه صريح فيه، لغلبة الاستعمال. وكذلك إذا نوى الإبانة لأنه قصد تنجيز ما علقه الشرع بانقضاء العدة فيرد عليه

( الطَّلَاقُ ) أَيْ التَّطْلِيقُ ( عَلَى ضَرْبَيْنِ : صَرِيحٍ ، وَكِنَايَةٍ ، فَالصَّرِيحُ قَوْلُهُ أَنْتِ طَالِقٌ وَمُطَلَّقَةٌ وَطَلَّقْتُك يَقَعُ بِهَا طَلَاقٌ رَجْعِيٌّ ) لِكَوْنِ هَذِهِ الْأَلْفَاظِ صَرِيحَةً ، وَالصَّرِيحُ يَعْقُبُ الرَّجْعَةَ بِالنَّصِّ وَهُوَ قَوْله تَعَالَى { وَبُعُولَتُهُنَّ أَحَقُّ بِرَدِّهِنَّ } وَهُوَ يُشِيرُ بِتَسْمِيَتِهِ بَعْلًا إلَى أَنَّ الطَّلَاقَ الرَّجْعِيَّ لَا يُبْطِلُ الزَّوْجِيَّةَ

وَرُدَّ بِأَنَّهُ قَالَ أَحَقُّ بِرَدِّهِنَّ وَالرَّدُّ إنَّمَا يُسْتَعْمَلُ فِيمَا زَالَ عَنْهُ مِلْكُهُ

وَأُجِيبَ بِأَنَّ الْبَعْلَ فِي اللُّغَةِ اسْمٌ لِلزَّوْجِ حَقِيقَةً وَهِيَ لَا تُتْرَكُ إلَّا بِدَلِيلٍ، وَأَمَّا لَفْظُ الرَّدِّ فَقَدْ يُسْتَعْمَلُ فِيمَا لَمْ يَزُلْ مِلْكُهُ كَالْبَائِعِ جَارِيَةً بِالْخِيَارِ لَهُ وَلِلْمُشْتَرِي فَإِنَّهُ لَمْ يَثْبُتْ الْمِلْكُ فِيهَا لِلْمُشْتَرِي

وَلَا يَفْتَقِرُ إلَى النِّيَّةِ لِأَنَّهُ صَرِيحٌ فِيهِ ) وَالصَّرِيحُ مَا ظَهَرَ الْمُرَادُ بِهِ ظُهُورًا بَيِّنًا بِكَثْرَةِ الِاسْتِعْمَالِ وَهَذَا كَذَلِكَ ، وَالصَّرِيحُ يَقُومُ لَفْظُهُ مَقَامَ مَعْنَاهُ فَلَا يَفْتَقِرُ إلَى النِّيَّةِ

وَقَوْلُهُ وَكَذَا إذَا نَوَى الْإِبَانَةَ ) مَعْطُوفٌ عَلَى قَوْلِهِ وَإِنَّهُ يَعْقُبُ الرَّجْعَةَ : يَعْنِي إنْ لَمْ يَنْوِ شَيْئًا ، وَكَذَا إذَا نَوَى الْإِبَانَةَ لِأَنَّهُ خَالَفَ الشَّرْعَ حَيْثُ قَصَدَ تَنْجِيزَ مَا عَلَّقَهُ الشَّرْعُ بِانْقِضَاءِ الْعِدَّةِ ، قَالَ اللَّهُ تَعَالَى { فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ } وَالْإِمْسَاكُ بِالْمَعْرُوفِ هُوَ الرَّجْعَةُ ، وَالتَّسْرِيحُ بِالْإِحْسَانِ هُوَ تَرْكُهَا حَتَّى تَنْقَضِيَ الْعِدَّةُ

فالأصل في جميع ألفاظ الكنايات أنه لا يقع الطلاق إلا بالنية،

( الفصل الخامس في الكنايات ) لا يقع بها الطلاق إلا بالنية أو بدلالة حال كذا في الجوهرة النيرة .ثم الكنايات ثلاثة أقسام ( ما يصلح جوابا لا غير ) أمرك بيدك ، اختاري ، اعتدي ( وما يصلح جوابا وردا لا غير ) اخرجي اذهبي اعزبي قومي تقنعي استتري تخمري ( وما يصلح جوابا وشتما ) خلية برية بتة بتلة بائن حرام والأحوال ثلاثة (حالة) الرضا ( وحالة ) مذاكرة الطلاق بأن تسأل هي طلاقها أو غيرها يسأل طلاقها ( وحالة ) الغضب ففي حالة الرضا لا يقع الطلاق في الألفاظ كلها إلا بالنية والقول قول الزوج في ترك النية مع اليمين وفي حالة مذاكرة الطلاق يقع الطلاق في سائر الأقسام قضاء إلا فيما يصلح جوابا وردا فإنه لا يجعل طلاقا كذا في الكافي
