Assalamu Alaikum mufti Sahab, I purchase a land in a village and build a kuchcha house for my family and kid.i apply for electricity but didn’t connection.i approached to SDO (electricity Dept) and requesting him to allot us new connection from one year & also offered him big money to speed up the process but he lingered.i went to zonal head then MD but nobody is responding.after one year to see my situation one of my neighbour offered me to connect the wire from his transformer to get temporarily electricity.can I use it temporarily until i get the connection.i have no other option.its impossible to survive without electricity.why should I deprive from my legaI right.everyone in my neighbourhood having electricity.i pay regular taxes and income tax every year.please advise if I can take temporary connection from my neighbor is it right to get legal right.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
We understand the predicament you find yourself in. On the one hand, you are required to abide by the laws of the country you reside in. On the other hand, you have been deprived of your legal right. We know that you would not like to disobey the law of the land, but you feel compelled to take matters into your own hands given that all legal avenues have failed you. In these circumstances, you will be excused to make use of your neighbours connection. [1] In doing so, avoid being put in an embarrassing situation. The Holy Prophet (Sallallahu Alayhi Wasallam) has said, [2]
“لاَ يَنْبَغِي لِلْمُؤْمِنِ أَنْ يُذِلَّ نَفْسَهُ”

اعْلَمْ أَنَّ الْإِعَارَةَ نَوْعَانِ: حَقِيقَةٌ، وَمَجَازٌ. فَالْحَقِيقَةُ: إِعَارَةُ الْأَعْيَانِ الَّتِي يُمْكِنُ الِانْتِفَاعُ بِهَا مَعَ بَقَاءِ عَيْنِهَا كَالثَّوْبِ وَالْعَبْدِ وَالدَّارِ وَالدَّابَّةِ. وَالْمَجَازُ: إِعَارَةُ مَا لَا يُمْكِنُ الِانْتِفَاعُ بِهِ إِلَّا بِاسْتِهْلَاكِهِ كَالدَّرَاهِمِ وَالدَّنَانِيرِ وَالْمَكِيلِ وَالْمَوْزُونِ وَالْعَدَدِيِّ الْمُتَقَارِبِ، فَيَكُونُ إِعَارَةً صُورَةً قَرْضًا مَعْنًى ; لِأَنَّهُ رَضِيَ بِاسْتِهْلَاكِهِ بِبَدَلٍ، فَكَانَ تَمْلِيكًا بِبَدَلٍ وَهُوَ الْقَرْضُ

(قَوْلُهُ هِيَ تَمْلِيكُ الْمَنَافِعِ بِغَيْرِ عِوَضٍ) وَهَذَا تَعْرِيفُهَا شَرْعًا وَأَشَارَ بِهِ إلَى الرَّدِّ عَلَى الْكَرْخِيِّ الْقَائِلِ بِأَنَّهَا إبَاحَةٌ وَلَيْسَتْ بِتَمْلِيكٍ وَيَشْهَدُ لِمَا فِي الْمَتْنِ الْأَحْكَامُ مِنْ انْعِقَادِهَا بِلَفْظِ التَّمْلِيكِ وَجَوَازِ أَنْ يُعِيرَ مَا لَا يَخْتَلِفُ بِالْمُسْتَعْمِلِ وَلَوْ كَانَ إبَاحَةً لَمَا جَازَ لِأَنَّ الْمُبَاحَ لَهُ لَيْسَ لَهُ أَنْ يُبِيحَ لِغَيْرِهِ وَإِنَّمَا لَا يُفْسِدُ هَذَا التَّمْلِيكَ الْجَهَالَةُ لِكَوْنِهَا لَا تُفْضِي إلَى الْمُنَازَعَةِ لِعَدَمِ لُزُومِهَا كَذَا قَالَ الشَّارِحُونَ

– قال: وكتب إلي أبو سعيد، ثنا أحمد بن سعيد، ثنا الحسن بن زياد، أنبأ أبو حنيفة حدثنا عبد الله بن دينار، عن ابن عمر رضي الله عنهما قال: قال رسول الله صلى الله عليه وسلم: ليس للمؤمن أن يذل نفسه، قيل: يا رسول الله! وكيف يذل نفسه قال: يتعرض من البلاء ما لا يطيق
سنن الترمذي ت بشار (4/ 93)
– حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، قَالَ: حَدَّثَنَا عَمْرُو بْنُ عَاصِمٍ، قَالَ: حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ، عَنْ عَلِيِّ بْنِ زَيْدٍ، عَنِ الحَسَنِ، عَنْ جُنْدَبٍ، عَنْ حُذَيْفَةَ قَالَ: قَالَ رَسُولُ اللهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: لاَ يَنْبَغِي لِلْمُؤْمِنِ أَنْ يُذِلَّ نَفْسَهُ قَالُوا: وَكَيْفَ يُذِلُّ نَفْسَهُ؟ قَالَ: يَتَعَرَّضُ مِنَ البَلاَءِ لِمَا لاَ يُطِيقُ.
هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ
