I cannot fulfil a court order to pay maintenance for my wife. What do I do?

​Aslaamuwalikum Sir,I am from Mumbai,Maharashtra,IndiaI gave Talaq Ahsan to my ex-wife  relieved her from matrimonial bonds after reconciliation failed between us.I had handed over the Mehr money to her.Now Talaq Ahsan is completed.My ex-wife filed a case in the court for maintenance,the Hon’ble court has passed Rs 10000/- per month as part of maintenance.I am working as a Sales Executive and my salary is Rs 10000/-,it is not possible for me to fulfill the court order based on my income as I have to bear my expenses too in the same salary.I will have to fulfill the Hon’ble court order,in order to avoid Jail term over non-payment.I have approached many trust and some people for help to fulfill this order.The trust and people informed me that they can help to some extent not complete but it will be in a way of Zakaat and some people said they will hand me Bank Interest money.As you are Islamic Scholar can you please provide your views with respect to Islamic Law(Quran and Hadeeth),Is it correct as per Islamic Law to collect Zakaat & Bank Interest money on behalf of my ex-wife to avoid consequences of jail?

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

According to Shari’ah, your ex-wife is entitled to maintenance until the end of her iddah period of talaq.[1] She is not entitled to maintenance thereafter. Her claim of maintenance against you is un-islamic and an oppression.

If you are compelled to pay the maintenance as per the court order, then you may use interest money to pay for the haram maintenance claim against you.[2]

العلائية: (ولو خلط السلطان المال المغصوب بماله ملكه فتجب الزكاة فيه ويورث عنه) ؛ لأن الخلط استهلاك إذا لم يمكن تمييز عند أبي حنيفة، وقوله أرفق إذ قلما يخلو مال عن غصب، وهذا إذا كان له مال غير ما الشامية: استهلكه بالخلط منفصل عنه يوفي دينه وإلا فلا زكاة، كما لو كان الكل خبيثا كما في النهر عن الحواشي السعدية

(قوله: كما لو كان الكل خبيثا) في القنية لو كان الخبيث نصابا لا يلزمه الزكاة؛ لأن الكل واجب التصدق عليه فلا يفيد إيجاب التصدق ببعضه. اهـ.
