Should I remarry? Is it permissible for my ex-wife to take my children to her home country?

Assalamalaikum

Troubled Relationship – Please advise

We are originally from India and now live in australia
We have been married for 9 years and have 2 kids, aged 5 and 1. We have had a turbulent relationship all along and were close to separation few times. I finally decided that there is no way forward and said Talaaq and after 3 months she moved out with kids renting a house near my place. I try to spend as much time as possible with kids. I love them and they love me very much. I just pray to Allah that my children don’t suffer due to our situation but it feels like they will.
The trouble was that she always felt that I dont deserve her and has never respected me. She is disobedient and wants me to be her slave. There is absolutely no question of reasoning or arguing with her. I have tried to stop talking to her, forsaking in bed, but she didn’t care. I also spoke to her father, but he threatened and dared me to divorce her. I had to apologise and then get back just like every other time. She resented to me having any contact with my parents in India. She has humiliated them on many occasions and does not even speak to them. She also resents to me talking to my parents on phone, my other family members or even make any friends here. So much so that we absolutely have no friends here now and are completely isolated. I feel that she has always felt ashamed of me and hence did not socialise with anybody. Her family in India is everything to her and she didn’t even let me be friendly with any of her family members.
The problem I have now is that I am very worried about how my kids will grow with us separating. I am wondering if it is wise to try to get back together (she might not agree) for the sake of my children even if it means I lead a life with no respect from my wife, no social contact, no friends, very little or no contact with my parents or family. Can I leave things as they are and hope things work out well and hope that Allah gives my kids a fulfilling and happy life. How far should I sacrifice for the sake of my kids? I cannot imagine a life without them and fear that my relationship with them will not be good if I remarry.
The other problem is that she is now trying to go back to India with my kids. She is now trying to get me into trouble by lodging false family violence cases and working on getting intervention order against my children citing children abuse. I obviously want my kids to stay with me and I can force her to stay here according to Australian law. Will I be committing a sin by forcing her to stay with the kids in Australia and not letting her go back to India( we are all Australian citizens)?She will not leave kids with me and go back. She was living alone here with almost no friends or social contact, but has now got her mother and brother here to support her.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

Respected brother,

We understand the predicament that you are in. This is all a test from Allah Ta’āla.

According to our understanding, you have divorced the woman and are pondering whether or not to re-marry her for the sake of your children.

Considering the information you have given to us, we advise you find a respected and influential member of your ex-wife’s family to speak with her and advise her to desist from her actions.

According to Sharῑ’ah, the custody of the children will be given to the mother, in the case of a male child until the age of 7[1] and in the case of a female child until the age of 9[2].

Thereafter, the custody will be given to the father, in the case of a male child until physical maturity (bulūgh), after which they are adults and may live by themselves.[3] In the case of a female child, the custody of the father shall remain until she is married.[4] [5]

Also, the father shall remain responsible of the maintenance for the child when the child is in the custody of the mother.[6]

Irrespective of whether the mother or the father has custody of the child, the parent that does not hold the custody of the child shall hold the rights of visitation of the child.[7]

Accordingly, you should exercise your right and prevent your wife from going to India. In doing so, you will not be committing a sin.[8]

قال في “الهداية” ووجهه أنه إذا استغنى يحتاج إلى التأديب والتخلق بآداب الرجال وأخلاقهم والأب أقدر على التأديب والتثقيف

والخصاف قدر الإستغناء بسبع سنين اعتبارا للغالب اهـ

فإن قال قائل هلا خيرت الغلام؟ لما روى زياد بن سعد عن هلال بن أسامة عن سليم أبي ميمونة عن أبي هريرة أن رجلا طلق امرأته واختصما في ابنها منه فقال النبي صلى الله عليه وسلم “يا غلام هذه أمك وهذا أبوك فاختر أيهما شئت فأخذ الغلام بيد أمه” قيل له يجوز أن يكون الغلام قد كان بلغ ويدل عليه ما ذكر في هذا الحديث أنها قالت يا رسول الله! إنه يريد أن ينزع ابني مني وقد نفعني وسقاني من بئر أبي عنبة وقد روى أن عليًا خير غلاما قد بلغ وقال لأخ له صغير لو قد بلغ هذا أيضا خيرناه

قلت وفي السراجية إذا سقطت حضانة الأم وأخذه الأب لا يجبر على أن يرسله لها بل هي إذا أرادت أن تراه لا تمنع من ذلك

وإذا تزوجها في قرية رستاق لها قرى قريبة بعضها من بعض فأرادت أن تخرج بولدها من قرية لها ذلك ما لم تقطعه عن أبيه إذا أراد أن ينظر ولده كل يوم وكذا الأب إذا أراد أن يخرجه إلى مثل ذلك

[8] رجل تزوج امرأة من أهل الشام بالشام فقد بها الكوفة وطلقها وقد ولدت منه فلها أن تخرج بالولد إلى الشام وإن كان تزوجها في غير الشام أو بالكوفة وهي من أهل الشام لم يكن لها أن تخرج بالولد من الكوفة

الجامع الصغير للإمام محمد ت189ه (237) إدارة القرآن – 1990م

والصحيح من قولهم ما ذكره محمد في كتاب الطلاق وهو أنه ليس لها أن تخرجهم من البلد الذي طلقها فيه إلا إلى بلدها إذا كانت عقدة النكاح فيه وليس لها أن تخرجهم إلى بلد غير بلدها وإن وقعت فيه عقدة النكاح ولا إلى بلدها إذا لم تقع فيه عقدة النكاح

والأصل في ذلك أن في الاغتراب بالأولاد ضررا عليهم فليس لها أن تفعل ذلك إلا أن يكون عقد النكاح وقع في بلدها فلها أن تخرج بهم إليه وذلك لأن وطنها في ذلك الموضع إنما استحق عليها بعقد النكاح فمتى ارتفع العقد عاد حكم وطنها الذي كانت فيه على ما كان عليه لأن الزوج إنما استحق إخراجها عن وطنها بالعقد فإذا ارتفع العقد فها أن ترجع إلى بلدها بالأولاد لزوال المنى الذي من أجله استحق عليها الكون هناك كما أنها لو أخرجت الأولاد بعد الطلاق من بلدها كان لها أن تردهم إلى بلدها لأن فيه ردا للأولاد إلى وطنها وليس فيه اغتراب بالأولاد وأما إذا لم يكن عقد النكاح في بلدها فليس لها أن تخرجهم إلى بلدها ولا إلى غيره لأنها لم تستحق عليه الكون في بلدها بعقد النكاح إذ قد كانت في غير بلدها قبل العقد فصار بلدها وغير بلدها سواء في حق الأولاد ومنعها إخراجهم إلى شيء من البلدان

وإذا أرادت المطلقة أن تخرج بولدها من المصر فليس لها ذلك “لما فيه من الإضرار بالأب” إلا أن تخرج به إلى وطنها وقد كان الزوج تزوجها فيه “لأنه التزم المقام فيه عرفا وشرعا”

(وإذا أرادت المطلقة أن تخرج بولدها من المصر) إلى مصر آخر وبينهما تفاوت بحيث لا يمكنه أن يبصر ولده ثم يرجع في نهاره (فليس لها ذلك) لما فيه من الإضرار بالأب لعجزه عن مطالعة ولده

(إلا أن تجرخه إلى وطنها وقد كان الزوج تزوجها) أي عقد عليها (فيه) أي وطنها ولو قرية في الأصح كما في “الدر” لأنه التزم ذلك عادة لأن من تزوج في بلد يقصد المقام به غالبا…فالحاصل أنه لا من الأمرين جميعا الوطن ووجود النكاح وهذا كله إذا كان بين المصرين تفاوت

If the wife wants to move away from the city, then this may be of two types:

1)     There is a considerable distance between the father and the land that the wife intends to take the children

This may be of four types:

  1. She is reverting to her home land (whether town or city) and her marriage took place in her home town

Ruling: this is permissible

  1. She is going to a land (whether town or city) and her marriage took place in that land

Ruling: although ‘Allamah Murghinani has mentioned two views for this scenario, he, and many other Hanafi Fuqaha have given preference to the view that this is impermissible.

  1. She is reverting to her home land (whether town or city) and her marriage did not take place in her home town

Ruling: this is impermissible

  1. She is going to a land (whether town or city) and her marriage did not take place in that land

Ruling: this is impermissible

2)     There is not a considerable distance between the father and the land that the wife intends to take the children

This may be of three types:

  1. She is reverting to land which is a town and is either not her home land and or her marriage did take place there

This may be of two types:

1-     She is currently in a town

Ruling: this is permissible upon the condition that the husband is able to see his children every day and return home. Otherwise, it is impermissible.

2-     She is currently in a city

Ruling: this is impermissible

  1. She is reverting to a land which is a city and is either not her home land and or her marriage did take place there

This may be of two types:

1-     She is currently in a town

Ruling: this is permissible upon the condition that the husband is able to see his children every day and return home. Otherwise, it is impermissible.

2-     She is currently in a city

Ruling: this is permissible upon the condition that the husband is able to see his children every day and return home. Otherwise, it is impermissible

  1. She is reverting to a land (whether town or city) which is her home land and her marriage took place there

Ruling: this is permissible under all circumstances
