The Shar’i ruling of abortion due to improper development of foetus

Dear Shaykh

An urgent response required:

My wife is ….. weeks pregnant; she had scans twice this week; including internal scan for the foetus. The doctor said the foetus has acrania, no skull bone development.  The brain tissue is seen free floating in the amniotic fluid. The doctor had said this is an serious abnormality and is not compatible with life. This is definite and based on examination by the team.  The baby may die during the pregnancy or after birth. The doctor said if we carry on with the pregnancy there is risk polyhydramnios  and dysocia in labour as there is no pressure from the presenting part. They explained if the baby is alive until the labour,  they may have to do an operation on my wife to  have the baby delivered, and upon delivery the baby may die or live up to couple of days.

Based on our situation can we terminate the pregnancy before reaching 120 days of pregnancy.

If we do decide to terminate, how would do the burial of this foetus.

We are very saddened about this news, please advise us also on how to relive our anxiety from this.

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

 Dear F Ahmed,

We took note of the contents of your email and the predicament in reference. We also feel your pain and sympathise with you and your family. We make dua Allah grant you and your family the courage to overcome this challenge and make it a means of closeness to Allah. May Allah also make it a means of eternal salvation.

Remember Allah is Al-Hakeem (The All-Wise).Every act of Allah is filled with wisdom. Allah says in the Quran:

{وَعَسَى أَنْ تَكْرَهُوا شَيْئًا وَهُوَ خَيْرٌ لَكُمْ} [البقرة: 216]

And it is possible that you might not like something while there is good in it 

Whilst you and your family may naturally experience grief in this instance, have conviction that Allah has kept good hidden in this apparent grief.

In principle, according to the situation explained by you and the advice of the medical experts, it is permissible to abort the pregnancy.[1] [2] [3] [4] [5] [6] [7]   10 11 12 13   As for the foetus, it should be given a name, bathed, respectfully covered without abiding by the normal kafan and buried in a normal way.14
