Husband saying to me that he wants me out of his life

Respected Mufti,

Assalaam Alaykum

I need urgent help, and will appreciate if you could please respond at your earliest convenience.

In a fit of anger, my husband said to me that “He wants me out of his life”. Later when e cooled down, I asked him what he intended. He clearly says that he did not intend divorce. What is the ruling of our marriage?

Wa’alaykum as Salam wa rahmatullahi wa barakatuhu,

The words you quoted your husband saying (i.e. “He wants me out of his life”) are not explicit words for Talaaq. The ruling of Shari’ah with regard to such ambiguous statements is that if the husband intended Talaaq, it will be regarded so, otherwise not. And with regards to whether he had an intention or not, his word will be accepted. In your case, your husband has said that he did not intend giving you Talaaq by using those words. Thus, the Talaaq has not taken place

أقول وكذا صرح بذلك في البحر والأشباه وعليه فالفرق بين الصريح والكناية أن الأول لا يحتاج إلى النية في القضاء فقط ويحتاج إليها ديانة والثاني يحتاج إليها فيهما لكن احتياج الأول إلى النية ديانة معناه أن لا ينوي به غير معناه العرفي فلو نوى الطلاق من الوثاق أي القيد لا يقع لصرفه اللفظ عن معن (رد المحتار – ط. بابي الحلبي (1/ 437)
