Is it allowed to make a separate jamah after the imam has finished the jamat in a mosque?

Answered as per Hanafi Fiqh by Darulifta-Deoband.com
I am from India. I came in Jeddah few days back, I found people do pray after jamah has been finished. They make their separate jamah. So I want to ask in India many Ulema told me it cannot be in masjid premises once jamah has been finished. They said you can do another jamah out of masjid premises. My question is that is it allowed to make jamah when jamat has been finished by imam?

Answer

(Fatwa: 355/466/N=1433)

In the mosque of the locality where imam and muezzin are fixed it is unlawful and makrooh tahrimi to offer salah with jama’ah after the people of the mosque have offered salah in the mosque with azan and iqamah. It is not correct to join such jama’ah. Those who join it do not get the virtues of jama’ah rather due to committing makrooh tahrimi act they become sinful. Yes, in the portion of mosque which is outside the Shariah mosque, if some people whose salah was missed by chance make second jama’ah then it is allowable. And Shariah evidences are the authority, not the sayings or practice of the people of any area especially when it is against Shariah.
