Is it permissible for a person who intends to fast the next day to eat and drink and make love to his wife at night, after he makes the intention?

Answer:
In the Name of Allah, Most Gracious, Most Merciful

Yes, it is permissible for a person who intends to fast an obligatory or supererogatory fast the next day to eat and drink and make love to his wife at night, after having made the intention, until dawn, as our imams have stated, such as Imam al-Nawawi in the Minhaj. Ibn Hajar said in the Tuhfa, “This is because Allah Most High has permitted eating until the rise of dawn.” (3:389)

السؤال : هل يجوز لمن نوى صومَ غدٍ من رمضان أن يأكلَ ويشربَ ويجامعَ زوجته في الليل بعد النية ؟ الجواب : نعم يجوزُ لمن نوى صومَ فرض أو نفل أن يأكلَ ويشربَ ويجامعَ زوجته في الليل بعد النية وقبل الفجر كما صرح بذلك أئمتنا كالإمام النووي في “المنهاج” قال في “التحفة” (3/389) :” لأنه تعالى أباح الأكلَ إلى طلوع الفجر “. اهـ
