Alimony and Child Support

Answered as per Hanafi Fiqh by ShariahBoard.org

My wife and I were first separated (she was pregnant) then divorced after the birth of child. Now question is how long (and how much) I have to pay the expenses of the child and mother. Is it necessary to pay the expenses of mother before the birth of child. Who is going to decide the amount. I am not in a position to pay the huge sum of amount. Who is responsible for the custody of child and from what age. Presently the boy is with mother since birth. (Now the age is 2 yrs).

If you were living together before the divorce all the expenses were on the husband. If the wife left the house to her parents home than the husband is not responsible for her individual expenses. After divorce the waiting period expenses have to be incurred by the husband along with expenses of the kids. If it were a kid he would stay with his mother until the age of seven and the father will pay for all of his expenses. From the Islamic law point of view the father will pay for the kid based on his ability but there could be some flexibility with mutual understanding of husband and wife about expenses of the kids. You should consult with the scholars about this.
