One Talaq/Divorce – What’s Next?

I was wondering what the procedures to be followed after 1 talaq is? Please feel free to email me back or call me at contact info below.

There are two situations in case of issuing one divorce:

  • The husband reconciles with the wife during the period of ‘iddat with or without consentor agreement of the wife, through verbally stating that “I reconcile” or by performing an action such as kissing or establishing marital relations which will constitute an automatic reconciliation between the couple.
  • The husband does not reconcile with the wife during the period of ‘iddat which will lead to the woman getting free from the husband’s Nikah upon the completion of this period. After that the woman is free to move forward with a new Nikah(whether with the same husband or another man).

If after the divorce, both the husband and wife realize that they can fulfill each other rights amicably and will follow the commandments of Allah Subhanahu Wa Ta‘alathen it is better to reconcile, otherwise it is not.

فَاِمۡسَاكٌ ۢ بِمَعۡرُوۡفٍ اَوۡ تَسۡرِيۡحٌ ۢ بِاِحۡسَانٍ‌ ؕ(سورہ بقرہ ، القرآن)اَلطَّلَاقُ مَرَّتٰنِ

(اذا طلق الرجل امراتہ تطلیقۃ رجعیۃ  او تطلیقتین فلہ ان یراجعہا فی عدتھا رضیت المراۃ بذٰلک ولم ترض، والرجعۃ ان یقول راجعتک او راجعت امرأتی او یطاھا او یقبلھا (حاشیہ فتاویٰ محمودیہ، ص290، بحوالہ ھدایہ
