If married to a Shia

Answered as per Hanafi Fiqh by ShariahBoard.org

I went against my better judgement and married a Shia man. We have been married for years and have 4 kids. I now realize my mistake but I’m already in this situation. He is a nice man and he is good to me. Will I be punished for marrying him for the rest of my life? Will Allah forgive my mistake or is it too late because I already am married to him and cannot leave?

He is a good father and a good husband. I do not want to leave him. Is there anything I can Do? My kids are Sunni. I am raising them 100% Sunni and he is ok with that.

If a Shia is mild-tempered and doesn’t have corruption in his beliefs then the Nikah done with him is valid, however, it is better to avoid. But if a Shia has the Kufriyah beliefs, e.g., he is convinced of the Ifk of Hazrat ‘Aaishah R.A., or is convinced of the Uloohiyat of Hazrat ‘Ali R.A., or is a believer of Hazrat Jibrael A.S. to make mistake in bringing the revelation, or has the belief of the changes in the Qur’aan then the Jurists have declared these beliefs to be the reasons for his Kufr and Irtidad (going out of the fold of Islam) and have written that a Sunni woman’s Nikah with such a man doesn’t take effect, it’s isn’t valid and it’s not correct for her to live with him and it’s necessary for her to have immediate separation from him. In such circumstance, the only way they could live together is to have him do repentance from such Kufriyah beliefs, do Nikah again, and then live together.
