Returning Purchased Items

Answered as per Hanafi Fiqh by Qibla.com

Answered by Shaykh Faraz Rabbani

I was wondering what the return policies in Islam are, say if you buy an item at the store, what are the circumstances under which you can return it? Can you return the item if you take it home, there’s no defect but you change your mind about it? Also can you get the product with the intention of returning it, i.e. you just buy a suit to go somewhere and return it the next day.

Answer:
In the Name of Allah, Most Gracious, Most Merciful

Walaikum assalam,

1. It is permissible to return the product as per the return policy of the store.

2. It is considered cheating to buy something with the express intention of using it and benefiting from it, and then to return it. The seller would normally not have accepted this, had they known.

The Prophet Muhammad (Allah bless him and give him peace) said, ” The one who cheats is not of us.” [Muslim, Ahmad, Tirmidhi, Ibn Maja, and others]

Imam Nawawi (Allah have mercy on him) explained this in his Sharh Sahih Muslim as meaning that the individual is not following the Prophet’s guidance, knowledge, practice, and noble way.

And Allah alone gives success.

Walaikum assalam,
Faraz Rabbani.
