Not comfortable with fatwa on stocks: does this make them haram for me?

Answered as per Hanafi Fiqh by Qibla.com

Answered by Shaykh Faraz Rabbani

I have read an extensive article on this website by Mufti Taqi Usmani regarding the permissibility of investing in the stock market. Although he seemed to make a very good case for the permissibility of investing in certain kinds of stocks if certain conditions are met, my heart still feels it is haram. Given this, would it be permitted for me to invest in the stock market, relying on the fatwa of Mufti Taqi Usmani and fulfilling the conditions that he outlined, even if in my heart I don’t believe that it is permitted and believe that the respected scholar is in error, even though I myself am not at the level of discernment?

Answer:
In the Name of Allah, Most Gracious, Most Merciful

Walaikum assalam wa rahmatullah,

The rulings of the Shariah are not established by heart inclinations; the deduction of capable recognized scholars does manifest the ruling of the Shariah regarding a particular matter.

The verdict of Mufti Taqi Usmani on stocks is confirmed in its general details by other major contemporary scholars.

Wassalam,
Faraz Rabbani
