Bleeding after abortion

Q: If a lady has an abortion and bleeds, will that bleeding be regarded as nifaas?

Bismillaah

A: If the limbs of the foetus (e.g. finger, hand, leg, etc) were formed, then the bleeding will be regarded as nifaas. If the limbs of the foetus were not formed then it will not be regarded as nifaas. In this case, if it is possible that the bleeding be regarded as haidh (e.g the blood flowed for three days or more and there was a clean period of 15 days or more that passed since the last haidh) it will be regarded as haidh. If it is not possible that the bleeding be regarded as haidh (e.g. the blood flowed for less than three days), it will be regarded as istihaazah.

And Allah Ta’ala (الله تعالى) knows best.

والسقط إن ظهر بعض خلقه من أصبع أو ظفر أو شعر ولد فتصير به نفساء هكذا في التبيين وإن لم يظهر شيء من خلقه فلا نفاس لها فإن أمكن جعل المرئي حيضا يجعل حيضا وإلا فهو استحاضة (هندية 1/37)

فإن لم يظهر له شيء فليس بشيء والمرئي حيض إن دام ثلاثا وتقدمه طهر تام وإلا استحاضة

قال الشامي: قوله ( والمرئي ) أي الدم المرئي مع السقط الذي لم يظهر من خلقه شيء (رد المحتار 1/303)
