Can a female make Tawaaf while experiencing her menses?
Question:
A young woman on her way to Makkah from Madinah realised at Thul Hulaifah that she has started bleeding. She assumed that this was Istihaadha as she was on tablets advised by the chemist.
On reaching Makkah she made intention and performed Umrah. She completed all the rites of Umrah including cutting of the hair. Thereafter she started using toothpaste, shampoo, etc. However after three days she realised that this was not Istihaadha but Haidh.
Should she now perform Qadhaa Umrah with the right intention and give Damm of one sheep or not?
Please advise, as they await the reply in Makkah from us.

Answer:
This lady who has completed all the rites of Umrah in the state of Haidh (Menses), has become Halaal and she is out of Ihraam. Her Umrah is valid and her becoming Halaal i.e. coming out of Ihraam is also correct. However after becoming Paak, it is necessary for her to repeat the Tawaaf. It will be better if she repeats the Sa’ee as well. If she does not repeat the Tawaaf, one Damm will become Waajib on her in the Haram. There is no need for her to make Qadhaa Umrah.
و في الدر المختار: “لو طاف للعمرة جنبا أو محدثا فعليه دم.”
و في الشامية: “و لو طاف للعمرة كلّه أو أكثره أو أقلّه و لو شوطا جنبا أو حائَََضا أو نفساء أو محدثا فعليه شاة … الي قوله و ان أعاده سقط عنه الدم”
و في البحر: “(قوله أو طاف لعمرة و سعي محدثا و لم يعد) أي تجب شاة لتركه الواجب و هو الطهارة. قيد بقوله و لم يعد لأنه لو أعاد الطواف طاهرا فانّه لا يلزمه شيء لارتفاع النقصان بالاعدة و لا يؤمر بالعود إذا رجع الي أهله لوقوع التحلل بأدء الركن مع الحلق و النقصان يسير و ما دام بمكة يعيد الطواف لأنه الأصل و الأفضل أن يعيد السعي لأنه تبع للطواف و ان لم يعده فلاشيء عليه و هو الصحيح لأن الطهارة ليست بشرط في السعي و قد وقع عقب طواف معتد به و أعادته لجبر النقصان كوجوب الدم لا لانفساخ الأول و لو قال المصنف محدثا أو جنبا لكان أولي لأنه لا فرق بين الحدثين في طواف العمرة كما في المحيط و غيره.
