Doubts about purity after periods

Answered as per Hanafi Fiqh by FatwaCentre.org
Question

I have doubts about the purity after periods, on 1st of May I had my periods at day time around 11 am or 12 pm. Then on 10th of may after Maghrib azan I took ghusl performed isha and even had intercourse with my husband. Then at suhur I woke up and took ghusland kept my fast. On 11th may At day time while i was fasting i came to know that maximum limit of periods as per hanafi fiqh is 240 hrs. And now i am doubtfull that if my fast is valid, should i break it or not. And if i am sinfull that i had intimacy with husbnd if i was not pure at that time. Plz help me with answer as i searched alot but i didnt find any answer. Plz keep in mind that i dont see signs of purity usually even after 10 days. usually i take bath on 11th day after fajar azan and perfrom prayer etc. This time i was concerned about My fast so i searched on the net and found that islamic new day starts after maghrib so i took ghusal etc

Answer

In the name of Allah, the Inspirer of truth

As your bleeding exceeded the maximum timeframe for menstruation (hayd) – 240 hours (ten days and nights), you must refer to your bleeding record to identify your place of habit. It is not necessary for hayd to be 10 days, rather it is possible that only the bleeding in your place of habit is hayd.

Your place of habit is the time of month you are expected to bleed. This is calculated using your last instances of valid blood and purity. A valid blood refers to the days of hayd spanning between 3-10 days. This can only be used as a habit if it is not followed by irregular bleeding (istihada). A valid purity is the gap between two valid bloods, which is 15 days or more and does not contain any bleeding or coloured discharge.

We cannot confirm whether your days of hayd ended on 11th May and if your fast on that day was valid or not. You will need to resubmit your question with details of your bleeding record going back to when you last had a valid blood and purity. You have mentioned that you do not usually see purity after 10 days of bleeding. It is necessary that you provide all the required information for us to calculate your habit.

Please note, if a woman cannot recall her habit, she will fall under the ruling of a mudilla, and can be subjected to some of the most stringent rulings in Islamic law (Shari’ah). To avoid this, it is essential you think back to your last valid blood and purity. Even if you cannot be certain, an estimation with which you are reasonably confident will suffice.

Lastly, sexual intercourse is prohibited during the days of hayd. If such a transgression takes place, both husband and wife should immediately repent and seek forgiveness. It is also recommended (mustahabb) for the husband to give charity to any zakat-eligible recipient. If sexual intercourse occurs during the middle/end of hayd, half of a dinar should be given in charity – this is equivalent to 2.125 grams of gold. And Allah knows best.
