[Follow Up] Husband’s right to refuse wife to leave the house…

Question:

Thank you for answering my previous question [Here] . However, I would like you to clarify something please. In the answer when you mention he may ask her not to go out even if he has no reason, does that mean that in marriage that a husband has the right to prevent her from visiting her friends completely even when he has no reason. So it is within his right to never allow her to see them? I understand that she must obey him, but does she at least have the right to be given permission to go out and see people?

I mean women have feelings after all. Is he sinful if he never allows her for no reason? or is she just expected to stay home and clean and he is allowed to lock her in and just serve him and never see her friends. In this case if he has the right to refuse for no reason, what is the difference between a married woman and slave?

I am sure no man would like to never be allowed to see his friends, then why is it not injustice to prevent the wife from going out even for no reason? Does social abuse even exist when it comes to the wife? Marriage seems so harsh and just like slavery.

JazākAllāhu Khayran for writing back and seeking further clarification. Your concern for properly understanding Islām is evident from your initial question and its follow up. May Allāh bless you and grant you His proximity.

In regard to your question, marriage is quite different than slavery. Allāh ﷻ explains to us the goal and desired outcome of a healthy marriage:

وَمِنْ آيَاتِهِ أَنْ خَلَقَ لَكُم مِّنْ أَنفُسِكُمْ أَزْوَاجًا لِّتَسْكُنُوا إِلَيْهَا وَجَعَلَ بَيْنَكُم مَّوَدَّةً وَرَحْمَةً ۚ إِنَّ فِي ذَٰلِكَ لَآيَاتٍ لِّقَوْمٍ يَتَفَكَّرُونَ (سورة الروم، آية ٢١)

“Of His signs is that He created spouses from among yourselves for you to live with in tranquility: He ordained love and kindness between you. There truly are signs in this for those who reflect.” (Sūrah Rūm, Āyah 21)

In this āyah, we are informed that love, mercy, and tranquility in marriage are signs of Allāh. This description is nothing like slavery. However, in order to properly understand the Islāmic concept of the rights, responsibilities, and mutual relationships that marriage entails, it is necessary to keep a few points in mind.

  1. The modern conception of equality is based only on rights. In other words, for a man and woman to be equal, they need to have the exact same rights. Men and women are equal in Islām, but Islām’s concept of equality is based on an exchange of rights and responsibilities. [1]
    1. Both genders have certain rights. Their rights are responsibilities in regard to the other gender and vice versa.
  2. Islām places emphasis on managing our relationships properly, and there is a hierarchical structure in human relationships. Some people have more rights than others. [2]
  3. There is the letter of the law and the spirit of the law. The spirit of the law is the ideal, and it should be strived for. But at times, problems arise, and it is necessary to have a set of agreed upon laws to refer to. Otherwise, the situation will descend into anarchy with no path to resolution.
  4. Everything humans do has some cause. However, it is not necessary that everyone is aware of it.

We can now apply these points to your question.

  1. Equality in Islām is Based on an Exchange of Rights and Responsibilities

In marriage, both husband and wife have certain rights. These rights translate to responsibilities for the other spouse. One of the rights that a wife has is the right for all of her living expenses to be taken care of. She is allowed to keep all of her money, and never needs to spend it on her husband. This right of the wife results in her husband having the responsibility to take care of all of her living expenses (at a standard that is reasonable). In return for the wife having this right, the husband also has a right, and his wife has a corresponding responsibility. The husband has the right to be respected and obeyed, and this includes stopping his wife leaving the house in some cases, and the wife has the responsibility to act accordingly.[3]

  1. Our Relationships Have Hierarchies

A husband’s right to stop his wife from leaving the house is not completely unrestricted. For example, she has the right to visit her parents on a regular basis, even if her husband forbids her from doing so. [4]. This is because Allāh has given parents such a high place in the hierarchy of relationships that it overrides the husband’s right. This right of visitation extends to other relatives as well, albeit at a different level than that of parents. Other situations also exist when the wife may leave the home without her husband’s permission. [5]

When considering the case of a husband stopping his wife from seeing her friends, it is necessary to see where a woman’s husband and where her friends belong in the hierarchy of relationships. Her husband has more of a right on her than her friends. [6]

  1. The Spirit of the Law vs. The Letter of the Law

The previous discussion was based strictly on the letter of the law – rights that each spouse reserves, but that should only be exercised in emergencies. [7] The spirit of the law is to have a loving relationship filled with respect, mutual understanding, and consideration for one another’s wants, desires, and interests. The Qurʾān and Sunnah emphasize this repeatedly. [8]

However, there are times when possessing these rights is essential to protect oneself and even the other spouse. Let’s take two examples:

a. A very wealthy woman with a stable job is married to a man who is struggling financially. Would the wife refuse to help her husband pay for the home, food, and clothing? In the vast majority of the cases, of course not. In a healthy, thriving marriage, both spouses help and complete one another. They make up for each other’s shortcomings and comfort one another in times of hardship. She absolutely would help her husband.

However, a time may come when the wife realizes that her husband is taking advantage of her ability to support the family and not actively looking for a job. She realizes that “tough love” is needed to push him to better himself. Or, if she feels that the marriage is failing, she needs to protect her assets. The fact that she reserves this right is now very relevant.

b. A woman has a large friend circle, and it is an important part of her life. Spending time with them is not affecting her fulfilling her household duties. In a healthy, thriving marriage, would a husband prevent his wife from seeing them? In the vast majority of cases, he would not.

However, a situation may arise husband may feel that his wife’s friends are having a negative influence on her. Her connection with them prevents her from realizing this, but to the husband, it is evident. He feels that her seeing certain people is affecting her dīn or disrupting the harmony of the home. The fact that he reserves this right is now very relevant.

  1. Not Everyone Is Aware of the Reason for an Action

In the two examples given above, it is not necessary that the husband or wife reveals their motivation for exercising their right. It may seem to their spouse that they are doing it without any rhyme or reason. However, the collective human experience teaches us that there is always a motivation for our actions. This motivation may not always be apparent, and at times, it is necessary to conceal.

A Final Thought

In your question, you essentially expressed concerns about a husband having certain rights, namely the right of preventing his wife to visit friend. Yes, the husband possesses this right along with other rights. Similarly, he has many responsibilities he must fulfill for his wife. As we have discussed above, the mere presence of this (and other) rights is not negative, nor does it necessitate that they will be acted upon. In many, many marriages, these rights are never exercised. Even when this (or another apparently negative) right is exercised, it is usually not the main problem in the marriage. It is symptomatic of underlying issues between the spouses. Islām lays out a comprehensive method of addressing marital disputes as well, and these can be learned with a thorough study of the tafsīr of Sūrahs Baqarah, Nisā, and Aḥzāb amongst others.

An Islāmic marriage is a union of bliss and harmony. Rules and regulations exist for both parties, but are they slavery? No! They are part of a formula that will free husband and wife from sorrow in this world and the next!

Just as in every aspect of our life, Allah gives guidelines setting boundaries for our servitude to Him. We try our level best to abide by these boundaries and remain as safe from doubtful as possible. Thereafter, we beseech Allah’s maghfirah from any shortcomings from our ends. The husband shall try the same for his own duties towards Allah whereas the wife will try to accomplish her part. Their union will provide them both a partner who assists the other in achieving the perfect servitude towards Allah. In this, they will find a bliss and harmony, which they will also cherish in the hereafter.

التفسير الكبير، تحت قوله تعالى: وَإِذْ أَخَذْنَا مِيثَاقَ بَنِي إِسْرَائِيلَ لَا تَعْبُدُونَ إِلَّا اللَّهَ وَبِالْوَالِدَيْنِ إِحْسَانًا الآية ، ج٣ ص١١٥٠-١٥٢، دار الكتب العلمية، الطبعة الرابعة
إنما أردف عبادة الله بالإحسان إلى الوالدين لوجوه. أحدها: أن نعمة الله تعالى على العبد أعظم، فلا بد من تقديم شكره على شكر غيره ثم بعد نعمة الله فنعمة الوالدين أعم النعم، وذلك لأن الوالدين هما الأصل والسبب في كون الولد ووجوده كما أنهما منعمان عليه بالتربية، وأما غير الوالدين فلا يصدر عنه الإنعام بأصل الوجود، بل بالتربية فقط، فثبت أن إنعامهما أعظم وجوه الإنعام بعد إنعام الله تعالى… اعلم أن حق ذي القربى كالتابع لحق الوالدين لأن الإنسان إنما يتصل به أقرباؤه بواسطة اتصالهم بالوالدين والاتصال بالوالدين مقدم على الاتصال بذي القربى، فلهذا أخر الله ذكره عن الوالدين

وفي مجموع النوازل: فإن كانت قابلة أو غسالة أو كان لها حق على آخر أو لآخر عليها حق تخرج بالإذن وبغير الإذن، والحج على هذا وما عدا ذلك من زيارة الأجانب وعيادتهم والوليمة لا يأذن لها ولا تخرج… فإن وقعت لها نازلة إن سأل الزوج من العالم وأخبرها بذلك لا يسعها الخروج، وإن امتنع من السؤال يسعها أن تخرج من غير رضاه، وإن لم تكن لها نازلة ولكن أرادت أن تخرج لتتعلم مسألة من مسائل الوضوء والصلاة إن كان الزوج يحفظ المسائل ويذاكر معها له أن يمنعها، وإن كان لا يحفظ الأولى أن يأذن لها أحيانا، وإن لم يأذن فلا شيء عليه، ولا يسعها الخروج ما لم يقع لها نازلة.
