My question is uss aadmi k liye kya hukm hai jo biwi k hotey hue apni saali sey naajayez taallukaat karley.

What is the ruling of such a person who has an illicit relationship with his sister in law in spite of having a wife?
Please guide us!
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.
At the outset, one should understand that it is not permissible to unnecessarily talk/chat to a non-Mahram. It is strictly forbidden to date and enter into an illicit relationship. To have an extramarital affair is a major sin. That incurs the wrath and anger of Allah Ta’ala.
Allah Ta’ala says in the Quraan:
وَلَا تَقْرَبُوا الزِّنَا إِنَّهُ كَانَ فَاحِشَةً وَسَاءَ سَبِيلًا
Translation: “And do not even go close to adultery. Indeed, it is ever an immorality and it is an evil way.”
(Surah Al-Israa, Aayah 32)
It is mentioned in a Hadeeth:
أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ “ لاَ يَزْنِي الزَّانِي حِينَ يَزْنِي وَهُوَ مُؤْمِنٌ وَلاَ يَسْرِقُ حِينَ يَسْرِقُ وَهُوَ مُؤْمِنٌ وَلاَ يَشْرَبُ الْخَمْرَ حِينَ يَشْرَبُهَا وَهُوَ مُؤْمِنٌ وَالتَّوْبَةُ مَعْرُوضَةٌ بَعْدُ
Translation: A fornicator who fornicates is not a believer as long as he commits fornication, and no one who steals is a believer as long as he commits theft, and no one who drinks wine is a believer as long as he drinks it, and repentance may be accepted after that.
(Saheeh Al-Muslim, Kitaab Al-Imaan)
Islam not only prohibits Zina, but also closes all the possible avenues leading to Zina. This is achieved by prohibiting every step and means leading to stimulating and aggravating desires.
Ahmad Shawki, the famed poet has succinctly described the end result of intermingling with non-Mahrams in the following couplet:
نـظـرة فابتسامة فسلام فـكـلام فـمـوعد فـلـقـاء
Translation: A glance, a smile then a greeting, a word, a promise then a meeting
A brother in law is a not a Mahram to the sister in law. It is strictly forbidden for the brother in law to have any type of relationship with the sister in law.
Nabi (ﷺ) said:
عَنْ عُقْبَةَ بْنِ عَامِرٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ” إِيَّاكُمْ وَالدُّخُولَ عَلَى النِّسَاءِ ” فَقَالَ رَجُلٌ مِنَ الأَنْصَارِ يَا رَسُولَ اللَّهِ أَفَرَأَيْتَ الْحَمْوَ قَالَ ” الْحَمْوُ الْمَوْتُ “
Translation: Beware of entering into the houses and meeting women (in seclusion). A person from the Ansar said: Allah’s Messenger, what about a husband’s brother, whereupon Nabi (ﷺ) said: The husband’s brother is like death.
(Saheeh Al-Muslim, Kitaab Al-Salaam)
A brother in law has easy access to his sister in law due to the flexibility in a family relationship. Such free access is accompanied with ones nafs and Shaytaan. It is compulsory for one to maintain complete hijab from ones brother-in-law.
It is mentioned in a Hadeeth:
قَالَ جَابِرٌ سَمِعْتُ النَّبِيَّ صلى الله عليه وسلم يَقُولُ “ إِذَا أَحَدُكُمْ أَعْجَبَتْهُ الْمَرْأَةُ فَوَقَعَتْ فِي قَلْبِهِ فَلْيَعْمِدْ إِلَى امْرَأَتِهِ فَلْيُوَاقِعْهَا فَإِنَّ ذَلِكَ يَرُدُّ مَا فِي نَفْسِهِ ”
Translation: When a woman fascinates any one of you and she captivates his heart, he should go to his wife and have an intercourse with her, for it would repel what has occurred in his heart.
(Kitaab Al-Nikaah, Saheeh Al-Muslim)
The man in reference should make sincere Tawbah and Istighfaar for the sin he is committing and make a firm resolve never to involve himself in an illicit relationship. He should cut off all ties with his sister in law. He should understand that his wife’s sister is Haraam for him. Allah has blessed him with a Halaal wife.
Furthermore, if his wife came to know about his illicit relationship with her sister, that will cause immense pain and grief to her. She will feel degraded and useless. She will feel her husband appreciates her sister more than her, yet she is the one that makes all the sacrifices for him. The man should ponder and reflect on the evils behind such a relationship.
