Can I Give My Friend’s Wife the Money Which He Has Left With Me As Trust?

Question:

I have a question. I am in a situation where I am holding some of my friend’s money and recently found out that he kicked out his wife and 3 kids from his house. His wife has contacted me about the situation and told me that he is not paying any child support. I am asking if it is okay for me to give her monthly expenses from the money that I am holding for him?

In the name of Allah, the Most Gracious, the Most Merciful

Answer:

It will not be permissible for you to give her the money. It is stated Al-Hidayah “If a stranger holds his wealth and he pays their maintenance without the permission of the Qadi, he is held liable.”1
