The issue of Halalah

Answered as per Hanafi Fiqh by DarulIftaBirmingham

Where can you go to get a halala done in the UK? It is very important please give me help.

In the name of Allah, Most Compassionate, Most Merciful.

Allah states in the Quran: So if a husband divorces his wife three times, it is not lawful for him to remarry her until after she has married another man and gotten divorced. In that case there is no blame on either of them if they reunite in marriage, provided they think that they can keep the limits of Allah. Such are the limits of Allah which He makes clear to the people of understanding.” (Surah Bakarah: 230)

Aisha (rai allahu anha) narrates, A man divorced his wife thrice (by expressing his decision to divorce her thrice), then she married another man who also divorced her. The Prophet was asked if she could legally marry the first husband (or not). The Prophet (sallal lahu alayhi wa sallam) replied, “No, she cannot marry the first husband unless the second husband consummates his marriage with her, just as the first husband had done.” (Sahih Al Bukhari, 7:187)

Halala means that the divorced woman marries another man and consummates the marriage with him, and then he either dies or divorces her for some reason. She now becomes free to marry her first husband after her waiting period is completed. For the couple to enter in to marriage on the condition that he divorces her after consummating the marriage, is extremely disliked. This agreement has been considered accursed in the Hadith, even though it will free the woman to marry her first husband again (Raddul Muhtar: Vol 2, P586).

In conclusion, there is no such place in the UK where halala is done as perceived by the majority of the public. It is not permissible to enter in to a marriage with that intention as stated above. The intention for the marriage should be to live together as a couple for rest of their life. However, if a person (who felt sorry for the couple) without any precondition marries the divorced woman purely for making her free to remarry her first husband (and does not let anybody know of his intention) … after consummating marriage with him and gaining a divorce she will become free to marry her first husband again. (Raddul Muhtar: Vol 2, P586).

And Allah knows best.
