Claiming for compensation after being attacked

Answered as per Hanafi Fiqh by DarulIftaBirmingham

Claiming for compensation after being attacked

In the name of Allah, the most Beneficent, the most Merciful.

Answer

Saaiduna Abdullah Ibn Abbas Radiallahu Anhu narrates that the Prophet of Allah Sallallahu Alahi Wasalam has said: “the first cases to be decided among the people (on the Day of Resurrection) will be those of blood-shed.”  (Sahih Bukhari p.1014 v.2)

With regards to your question, it will be permissible to claim for compensation for one who has been injured in an attack, whether by the attacker or the court or whether it is an insurance company (even though participating in commercial insurance is unlawful) or otherwise.

This is a right (haqq) of diyyah (compensation) and one is allowed to claim for it.
