Is triple talaaq valid?

Question:


Assalamu Alaikum Wa Rahmatullah!


If a person said talaq three times, is that talaq valid in Islam?

Answer:


Assalamu Alaikum Wa Rahmatullahi Wa Barakaatuh,


If by triple talaaq you mean saying the words of talaaq thrice then a person who repeats the words of Talaaq 3 times whether he has done so consecutively in one sitting or over a period of time, such as one Talaaq every month, the Talaaq is valid and one’s wife will have received a Mughallaz Talaaq.[1]


A Talaaq Mughallaz is such that one’s wife becomes permanently Haraam upon oneself unless the Halaalah process takes place.[2] Halaalah includes marriage with another man which is followed by intimate relationship and a divorce or death of the husband thereafter she may marry her previous husband with the completion of her iddah.


 


Doing so — repeating the words of Talaaq thrice in one sitting — is detestable and amounts to sin, however the Talaaq will still be valid.

[1] وَإِذَا قَالَ لِامْرَأَتِهِ أَنْتِ طَالِقٌ وَطَالِقٌ وَطَالِقٌ وَلَمْ يُعَلِّقْهُ بِالشَّرْطِ إنْ كَانَتْ مَدْخُولَةً طَلُقَتْ ثَلَاثًا وَإِنْ كَانَتْ غَيْرَ مَدْخُولَةٍ طَلُقَتْ وَاحِدَةً وَكَذَا إذَا قَالَ أَنْتِ طَالِقٌ فَطَالِقٌ فَطَالِقٌ أَوْ ثُمَّ طَالِقٌ ثُمَّ طَالِقٌ أَوْ طَالِقٌ طَالِقٌ كَذَا فِي السِّرَاجِ الْوَهَّاجِ. رَجُلٌ قَالَ لِامْرَأَتِهِ أَنْتِ طَالِقٌ أَنْتِ طَالِقٌ أَنْتِ طَالِقٌ فَقَالَ عَنَيْت بِالْأُولَى الطَّلَاقَ وَبِالثَّانِيَةِ وَالثَّالِثَةِ إفْهَامَهَا صُدِّقَ دِيَانَةً وَفِي الْقَضَاءِ طَلُقَتْ ثَلَاثًا كَذَا فِي فَتَاوَى قَاضِي خَانْ. مَتَى كَرَّرَ لَفْظَ الطَّلَاقِ بِحَرْفِ الْوَاوِ أَوْ بِغَيْرِ حَرْفِ الْوَاوِ يَتَعَدَّدُ الطَّلَاقُ وَإِنْ عَنَى بِالثَّانِي الْأَوَّلَ لَمْ يُصَدَّقْ فِي الْقَضَاءِ كَقَوْلِهِ يَا مُطَلَّقَةٌ أَنْتِ طَالِقٌ أَوْ طَلَّقْتُك أَنْتِ طَالِقٌ وَلَوْ ذَكَرَ الثَّانِيَ بِحَرْفِ التَّفْسِيرِ وَهُوَ حَرْفُ الْفَاءِ لَا تَقَعُ أُخْرَى إلَّا بِالنِّيَّةِ كَقَوْلِهِ طَلَّقْتُك فَأَنْتِ طَالِقٌ كَذَا فِي الظَّهِيرِيَّةِ.) الفتاوى الهندية ج 1 ص 390. دار الكتب العلمية)
