Is it legal to supply empty wine bottles to a contractor?

I have a question regarding business for one of my colleagues. He wants to do a business of supplying empty glass bottles by collecting from small contractors to a big contractor. In those most of the bottles are of empty wine bottles. Though the person is neither directly collecting these bottles from any wine shop nor supplying directly to a wine factory, but he wants to know the ruling before starting the business. Please reply in detail whether it is lawful or haram or some conditions he has to follow.

If those bottles are used only for wine or your friend is sure or almost sure that the empty bottles which he would supply to the contractor shall be supplied to any wine factory and it shall be used only for wine then this business is makrooh tahrimi. And if these bottles are used for other drinks instead of wine as well and your friend is not sure about his contractor that he only would supply them to wine factory then he can do this business. It is lawful as per the Shariah:
قال العلامة المفتي محمد شفيع رحمه الله تعالى في “تفصيل الكلام في مسئلة الإعانة على الحرام” : والثالث بيع أشياء ليس لها مصرف إلا فى المعصية ….. ففي جميع هذه الصور قامت المعصية بعين هذا العقد والعاقدان كلاهما آثمان بنفس العقد …… (جواهر الفقه 2:442) ………… وإن لم يكن – السبب – محركا وداعيا بل موصلا محضا وهو مع ذلك سبب قريب بحيث لا يحتاج في إقامة المعصية به إلى إحداث صنعة من الفاعل كبيع السلاح من أهل الفتنة …. وأمثالها فكله مكروه تحريما بشرط أن يعلم به البائع …… من دون تصريح به باللسان وإن لم يعلم كان معذوراً اهـ (حواله بالا 2: 447)
