Bleeding after Miscarriage

Q: I was 3 months pregnant, baby’s heartbeat was heard at a first appointment of which the scan detected 8 weeks at the time. At the 3 month appointment we found no heartbeat and according to scan baby had not grown since the previous scan which was approx 8 weeks as stated. I’ve read a masa’la (ruling) previously stating something with regards to whether baby was formed or not in determining nifaas (bleeding post birth)? Can Mufti saheb please assist me and explain as to whether the bleeding after an above-stated miscarriage is considered nifas or not?

A: If the miscarried foetus had any resembelence to a baby like the formation of one or more limbs then the bleeding post the miscarriage will be nifaas. However if the mis was not more than a cloth of blood or a lump of flesh and the bleeding prior and post the miscarriage fits the definition of haid (menses), i.e. the bleeding continued for more than 3 days and it came after 15 days of no bleeding which is oviously the case here as she was already pregnant for several months, then it will be haid. If any one of the two above conditions are not found then the bleeding will be consirdered isthihaada i.e. like a normal breaker of wudu.
