Can a city court issue a Khul` against my will?

Answered as per Hanafi Fiqh by Askimam.org

Recently court( city court karachi ) has granted khula to my wife without any investigation or valid reason. This is all against my will and wish. I just need to know such type of dissolution of marriage is valid in Islam or she is still my wife.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

In principle, it is necessary to have consent from both parties (husband and wife) in order to initiate a valid khul`.[1] However, since we are unaware of all the details regarding your case, we are unable to issue a blanket ruling on the status of your marriage. We advise you to contact one of the local Darul Iftaas in Karāchī and seek their guidance on the matter.  Alternatively, you may also send the court ruling with all the documents to us for our observations.
