Question pertaining to iddah

Answered as per Hanafi Fiqh by Askimam.org

My question is about iddah, me and my husband is separated from each other since one year, he didnt contacted me in all this time and also he never gave me my mehar or my nafqa, he didnt gave me Talaq but recently his lawyer in australia sent me a divorce application, and I have also requested in a court for khula in Pakistan. Both countries court have granted divorce to us. Can you please tell me the period of Iddah for me?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

We do not know the divorce application procedure in Australia or the khula procedure in Pakistan. Accordingly, we are unable to comment on the validity of the divorce or the khula.

The simple solution for you or your representative is to contact your husband to issue you a talaaq-e-baain (irrevocable divorce). Once he issues you the talaaq your iddat will commence, which will be three menstrual cycles if you experience menses, or alternatively three months if you don’t experience menses.[1]
