Do I have to pray Qasr Salaah?

Assalam u Alikum Sheikh,

Hope you are well. I have got 2 questions:

  1. I live in London (with my wife and kids) and recently have started a job in another city (Telford around 170 miles from my home) in central England. For this job I have to be in Telford from Mon – Fri. So I travel on Mon morning stay there 4 nights and travel back Fri afternoon. This will continue for at least 3-6 months. I want to ask is do I pray Qasr in Telford and regular in London or the other way round as I am staying in Telford more but London is my main home. I know if I would have stayed there 2 or 3 nights then I would have surely have done Qasr but I am not sure now as I am staying more in Telford. 
  2. I have got a private pension. I usually calculate Zakat on 1st Ramadan and pay zakat on whatever my online pension account is showing. But 1 of my friend recently was telling me that there is no zakat on pension account as it isnt in my possession as of now and I should pay zakat on it once I physically receive the pension amount. Please suggest.

Answer

In the Name of Allah, the Most Gracious, the Most Merciful. 

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. 

 

1)   In principle, a musafir (traveller whose journey exceeds 48 miles/78 kilometres) will not become a muqim until he firmly intends to stay at a place for a period of fifteen days from the time he makes this intention.[i]

 

In the enquired situation, you state you will not be residing in Telford for the duration of 15 continuous days. Therefore, you will continue praying Qasr Salaah. 

There is no consideration of where one spends majority of the week regarding the laws pertaining to Qasr Salaah.

 

2)    In regards to your private pension scheme, we require further clarification. You may send us details regarding your exact pension scheme to determine whether the money accumulated is Zakatable or not.

(قَوْلُهُ الْوَطَنُ الْأَصْلِيُّ) وَيُسَمَّى بِالْأَهْلِيِّ وَوَطَنِ الْفِطْرَةِ وَالْقَرَارِ ح عَنْ الْقُهُسْتَانِيِّ.

(قَوْلُهُ أَوْ تَأَهُّلِهِ) أَيْ تَزَوُّجِهِ. قَالَ فِي شَرْحِ الْمُنْيَةِ: وَلَوْ تَزَوَّجَ الْمُسَافِرُ بِبَلَدٍ وَلَمْ يَنْوِ الْإِقَامَةَ بِهِ فَقِيلَ لَا يَصِيرُ مُقِيمًا، وَقِيلَ يَصِيرُ مُقِيمًا؛ وَهُوَ الْأَوْجَهُ وَلَوْ كَانَ لَهُ أَهْلٌ بِبَلْدَتَيْنِ فَأَيَّتُهُمَا دَخَلَهَا صَارَ مُقِيمًا، فَإِنْ مَاتَتْ زَوْجَتُهُ فِي إحْدَاهُمَا وَبَقِيَ لَهُ فِيهَا دُورٌ وَعَقَارٌ قِيلَ لَا يَبْقَى وَطَنًا لَهُ إذْ الْمُعْتَبَرُ الْأَهْلُ دُونَ الدَّارِ كَمَا لَوْ تَأَهَّلَ بِبَلْدَةٍ وَاسْتَقَرَّتْ سَكَنًا لَهُ وَلَيْسَ لَهُ فِيهَا دَارٌ وَقِيلَ تَبْقَى. اهـ.

(قَوْلُهُ أَوْ تَوَطُّنِهِ) أَيْ عَزَمَ عَلَى الْقَرَارِ فِيهِ وَعَدَمِ الِارْتِحَالِ وَإِنْ لَمْ يَتَأَهَّلْ
